[HISTORY: Adopted by the Annual Town Meeting of the Town of Blackstone 3-28-1953 by Art. 35, as Section I of the Revised Bylaws. Amendments noted where applicable.]
All previous bylaws inconsistent with the bylaws hereinafter contained are hereby expressly repealed. If any article, section or subsection of any article of this Division 2 of the Code is declared unconstitutional or illegal by any court, or is disapproved by any state authority having jurisdiction thereof, the validity of the remaining provisions of this Division 2 of the Code shall not be affected thereby.
The repeal of a bylaw shall not thereby have the effect of reviving any bylaw thereto before repealed.
Words and phrases specifying or naming any officer, board or committee of the Town, shall be construed as including the lawful successor or the person having the powers and performing the duties of such officer, board or committee.
When in a bylaw anything is prohibited from being done without the license or permission of a certain officer, board or committee, such officer, board or committee shall have the right to license or to permit such things to be done.
Any or all of this Division 2 of the Code may be repealed or amended or other bylaws may be adopted by a two-thirds vote at any Town Meeting whenever an article or articles for that purpose have been inserted in the warrant for such meeting by the Board of Selectmen.
Whoever violates any provision of this Division 2 of the Code shall, unless other provisions are expressly made, forfeit and pay a fine of $50 for each offense, plus all court costs. The Board of Selectmen, through the Chief of Police, shall prosecute by filing a complaint in the District Court. Such penalties shall be paid into the Town Treasury.
