As used in this chapter, the following terms shall have the meanings indicated:
PUBLIC PLACE
Any street, alley, park, public building, any place of business or assembly open to or frequented by the public, and any business or assembly open to public view, or to which the public has access.
It shall be unlawful for any person to:
A. 
Commit an assault or an assault and battery on any other person.
B. 
Be under the influence of alcohol or of any controlled substance (as defined in 1978 PA 368, being MCLA § 333.7101 et seq., as amended) in any public place.
C. 
Discharge any firearm, air rifle, or air pistol within the Village limits, except a police officer or other peace officer in the course of his duty.
D. 
Fire, discharge, display, or possess any fireworks except of the type and under the conditions permitted under the laws of the State of Michigan.
E. 
Engage in peeping through the windows into any inhabited place.
F. 
Beg in any public place.
G. 
Swim or bathe in any public place without wearing apparel that completely covers from view the genital and buttocks areas for all persons, and which covers from view the breasts of female persons.
H. 
Engage in fortune-telling or pretend to tell fortunes for hire, gain, or reward.
I. 
Make any indecent exposure of his or her person by exposing portions of the body to others, including the exposure of the buttocks or genital area by males, and exposure of genital, buttocks, or breast areas by females.
J. 
Vend, sell, or distribute in any manner whatsoever any article or medicinal preparation primarily manufactured for, or which may be used as, a contraceptive, except sale or distributions by or to any licensed medical practitioner or registered pharmacist, or as may be permitted under state law.
K. 
Willfully destroy, remove, damage, or alter, or in any manner deface any property not his own, or any public school building, or any public building, bridge, fire hydrant, alarm box, streetlight, street sign, traffic control device, railroad sign or signal, parking meter, or shade tree belonging to the Village or located in the public places of the Village, or mark or post handbills on, or in any manner mar the walls of, any public building, or fence, tree, or pole within the Village, or destroy, take or meddle with any property belonging to the Village, or remove the same from the building or place where it may be kept, placed or stored, without proper authority; or disturb, tamper with, disconnect or damage any Village water meter without proper authority.
L. 
Destroy, injure or in any manner deface any drinking fountain located in the Village, or throw or deposit any substance therein, or in any manner pollute the water in the basin of any fountain or detach the cups or other parts of such drinking fountains.
M. 
Engage in any disturbance, fight or quarrel in any public place.
N. 
Jostle or roughly crowd persons in any street, alley, park, or public building.
O. 
Conduct himself on any street, sidewalk, park, public building, or any other public place so as to obstruct the free and uninterrupted passage of the public.
P. 
Play any game in any public street or sidewalk.
Q. 
Disturb the public peace and quiet by loud, boisterous, or vulgar conduct, such as by the unnecessary blowing or sounding of whistles, sirens or horns, or by the playing of a radio phonograph, musical instrument or loud-speaker or yelling, shouting or singing in a manner or with such volume as to annoy the comfort or repose of others, particularly between the hours of 10:00 p.m. and 7:00 a.m.
R. 
Permit or suffer any place occupied or controlled by property owner to be a resort of noisy, boisterous, or disorderly persons.
S. 
Obstruct, resist, hinder, or oppose any member of the police force or any peace officer in the discharge of his or her duties as such.
T. 
Prowl about any alley or private premises of any other person in the nighttime, without authority or permission of the owner of such premises.
U. 
Spit on any sidewalk or on the floor or seat of any public carrier, or on any floor, wall, seat or equipment of any place of any public assemblage.
V. 
Telephone any other person repeatedly or cause any person to be telephoned repeatedly for the sole purpose of harassing or molesting such other person or his family, whether or not conversation ensues (except for telephone calls made for legitimate business purposes), or use any threatening, vulgar, indecent, obscene, or insulting language over the telephone.
W. 
Sell, give away, use or possess for any purpose whatsoever any controlled substance (as defined in 1978 PA 368, being MCLA § 333.7101 et seq., as amended), except as provided and permitted under the laws of the State of Michigan.
Violations of this article shall be punishable as provided in Chapter 1, Article II, General Penalty, of the Code of the Village of Bellevue.
