Unless otherwise provided by law, charter provisions or ordinances, the time in which any act provided by law is to be done is computed by excluding the first day and including the last, unless the last day is a Sunday or holiday, then it is also excluded.
A. 
Definitions. As used in this chapter, the following terms shall have the meanings indicated:
COUNCIL
When used anywhere, construed to mean the City Council of the City of Breckenridge, Minnesota.
DAY
The period of time between 12:00 midnight and the 12:00 midnight following.
DAYTIME
The period of time between sunrise and sunset.
MONTH
A calendar month.
NIGHTTIME
The period of time between sunset and sunrise.
OATH
Includes an affirmation.
OWNER
As applied to any property, includes any part owner, joint owner, tenant in common, tenant in partnership, joint tenant or tenant by the entirety of the whole or any part of such property.
PERSON
Includes any person, firm, association, organization, partnership, business, trust, corporation or company.
PERSONAL PROPERTY
Includes every species of property except real property.
REAL PROPERTY
Includes lands, tenements and hereditaments.
TENANT or OCCUPANT
Applied to a building or land, includes any person holding a written or oral lease or who occupies the whole or any part of such building or land, either alone or with others.
B. 
Word usage.
(1) 
The masculine gender includes the feminine and neuter.
(2) 
The singular number includes the plural and the plural, the singular.
(3) 
Whenever certain hours are named in this code, they shall mean Central Standard Time or Daylight Saving Time as may be in current use in the City.
(4) 
"Shall" is mandatory and "may" is permissive.
(5) 
Unless otherwise clarified, the present tense includes the past and future tenses and the future includes the present.
A. 
The repeal of any ordinance, or any part thereof, shall not revive any ordinances in force before or at the time the ordinance repealed took effect.
B. 
The repeal of an ordinance shall not affect any punishment or penalty incurred before the repeal took effect or any suit, prosecution or proceeding pending at the time of repeal for any offense committed under the ordinance repealed.
Except as otherwise provided, every day any violation of any ordinance, resolution, rule or regulation or order shall continue shall constitute a separate offense.
