As used in this chapter, the following terms shall have the meanings indicated:
COIN-OPERATED MECHANICAL AMUSEMENT DEVICE
Any machine or device which upon the insertion of a coin, token or slug operates or may be operated by the general public for use as a game, music, entertainment or amusement. The term shall include so-called pinball machines, video games and all the machines, which by the insertion of a coin or token, operate for the amusement of the player, except machines used exclusively for weighing.

No person shall keep or maintain for operation within the City any such coin-operated mechanical amusement device unless a license therefor has been issued as hereinafter provided. No license shall be issued for any gambling device.

Applications for licenses shall be made to the City Administrator or his/her designee on forms provided by the City. The application shall be presented to the City Council for its consideration, and if granted by the Council, a license shall be issued by the City Administrator or his/her designee.
The annual license fee for each such device, other than a mechanical device operated only for musical entertainment and the annual license fee for each such musical device operated for only musical entertainment shall be the sum as provided in Chapter 86, Fees. In the event a license is applied for subsequent to the beginning of the license year, the pro rata portion of the annual license fee of the date of the issuance to the end of the license year shall be paid, and any portion of the month for the period so licensed shall be considered as a full month.
All licenses shall expire on the last day of June in each year.

Such devices so licensed may be replaced by a device of substantially similar design upon reporting the identification and description of such substituted device to the City Administrator or his/her designee.
No licensee shall permit any person to use such device for gambling. If any person violates this provision, the license may be revoked upon notice and hearing before the City Council.
Any person violating any of the provision of this chapter shall be guilty of a misdemeanor and upon conviction thereof, shall be punished as provided in Chapter 1, General Provisions, Article I, General Penalty.
