Purchase of pawn articles from minors — See Ch. 129.
No child under the age of 16 years shall be in or remain on the streets or alleys or in any public place in the City of Breckenridge between the hours of 11:00 p.m. and 5:30 a.m., except as follows:
A. 
When accompanied by their parents, guardians or some other adult person having custody or control of such child.
B. 
When they are attending, with the permission of their parents, guardians or some other adult person having custody or control, any function or activity sponsored by a church, a school, the City or the canteen operated under the supervision of the City, which necessitates their presence in a public place during such hours and then only for as long a time as it is reasonably necessary for them to complete their attendance at such function or activity and return to their place of residence.
Any children who violate the provisions of § 75-1 of this chapter may be taken into custody by the police and returned to their places of residence. Upon returning such child, the police shall immediately notify the parents, guardians or other persons having the care, custody or control of such children.
No parent, guardian or other person having the care, custody or control of children under the age of 16 years shall allow, permit or encourage them to go or remain in or upon the streets, alleys and public places in the City, contrary to the provisions of this chapter.

Any person violating any of the provisions of this chapter shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished as provided in Chapter 1, General Provisions, Article I, General Penalty, except for the following which shall be classified as a payable petty misdemeanor offense for the first two convictions. Upon a third violation within a five-year period for the exact same offense, it would then convert to a misdemeanor offense and a mandatory court appearance:
