A.
Except as provided, no person shall go in or upon any
private residence in the City of Breckenridge, Minnesota, for the purpose
of selling, peddling or hawking a service or soliciting money or orders for
merchandise, goods, wares or foods of any kind without first applying for
and being issued a permit from the Police Department. The permit will be shown
to each prospective residence customer before any sale or presentation is
attempted.
B.
Breckenridge residents and organizations who have been
established in the city for three or more months are not required to obtain
a permit. Breckenridge residents must, however, carry and display before attempting
a sale some form of identification showing that they are local residents,
i.e. identification from school, church, scout troop, paper boy, etc.
A.
Permits shall not be issued on or be valid on Sunday.
In no case shall any permit be valid for more than one year from the date
of issue.

A filing fee for the application in the amount as provided in Chapter 86, Fees, shall be required of all persons not otherwise exempted and cash as provided in Chapter 86, Fees, is required of each nonresident person issued a permit. Such deposit shall be forfeited to the City of Breckenridge if said permit is revoked by the police as provided for in § 132-7. The deposit will be returned when the permit is returned to the Police Department.
C.
Any application for a permit that is denied by the police
may be appealed to the City Council at the next regular meeting.
A.
Permits may be issued by the police after the following
information is obtained and an inquiry is made on each applicant:

At least two forms of identification shall be required,
one of which should be a driver's license.

The form of the application and permit shall be required
by the Chief of Police. A permit may not be issued within four hours of the
application.
Permits shall state that "the Police Department and the City of Breckenridge
do not endorse or guarantee any product or personal views presented and do
not endorse the salesperson." The permit shall only ensure that the bearer
has filed an application with the police and will be valid for the time specified
on the permit.
No person or firm shall sell, display or solicit money or orders for
food, goods, wares and merchandise on any street, alley, sidewalk or boulevard
in the City of Breckenridge, except that established businesses for special
promotional purposes may do so after notification to the public.
No person or firm shall temporarily sell, display or solicit money or
orders for foods, goods, wares and merchandise on private property without
the owners or managers written permission. Such permission shall include the
effective dates and time of the permitted operation. Such permission must
be in the immediate possession of the person at all times and available for
police inspection.
No person shall, in the course of hawking, peddling or soliciting commit
any act which will annoy, disturb or inconvenience people in their home or
which may tend or be likely to do so. Each such act will be grounds for immediate
revocation of permit by the Police Department.
No person shall go in or upon any private residence in the City of Breckenridge
for the purpose of soliciting contributions for any local charitable, educational,
religious, patriotic, civic, fraternal or commercial or other groups of this
nature, cause or purpose without first notifying the public of the dates and
time of such activities. Persons other than local residents must obtain a
permit as provided herein.
