As used in this chapter, the following terms
shall have the meanings indicated:
Includes any organic refuse and incidental admixtures thereto
resulting from the preparation of food, dead animals or any parts
of dead animals and any decayed or spoiled food from any source.
Includes all organic and inorganic wastes, except garbage,
resulting from any manufacturing, building, demolition, construction,
processing, repairing, grain cleaning, the operation of garages and
service stations and other similar activities.
Includes all waste materials, except industrial wastes, garbage
and human excreta.
Includes every type of waste material or matter from any
source.

It is unlawful to store, transport or dispose of any waste materials in the City of Breckenridge, Minnesota, except in compliance with the provisions of this chapter. Any violation of this article is hereby declared to be a public nuisance and may be abated by the City pursuant to the procedures established in § 118-25.
No wastes, including garbage, industrial wastes
and rubbish, may be burned in the city limits of the City of Breckenridge,
Minnesota, at any time in any outdoor open fire, outdoor incinerator,
can or other receptacle or device.
Any incinerator maintained and operated for
the purpose of destroying wastes must be approved by the Codes Administrator
for the City of Breckenridge and must comply with all applicable laws,
regulations and codes.
No garbage shall be kept or stored on any premises
in the City of Breckenridge, except in metal or plastic cans equipped
with flyproof covers. All garbage stored in such cans shall be wrapped
and drained of water and other fluids.
No waste materials shall be deposited on any
street, alley or public place in the City of Breckenridge, Minnesota,
except in approved garbage or rubbish receptacles provided for that
purpose.
No waste materials shall be stored or kept on
any premises in the City of Breckenridge, Minnesota, contrary to the
provisions of any other ordinance of the City of Breckenridge and
amendments thereto.
As to deposits, storage and transportation of
industrial wastes and rubbish, the provisions of this chapter shall
not apply to licensed junk dealers while operating on the licensed
premises.
The provisions of this chapter shall not apply
to any burning done in the City of Breckenridge under the supervision
of, or with the consent of, the Fire Department of the City of Breckenridge.
No person, firm or corporation shall transport
any waste materials on the streets and alleys in the City of Breckenridge,
Minnesota, without first taking adequate precautions to prevent the
scattering of such waste material in the course of such transportation.
All persons desiring the services of the licensed
collector shall comply with the following regulations, and the licensed
collector may discontinue furnishing garbage and refuse collection
service to any person violating said regulations. These regulations
are as follows:
A.
All garbage cans shall be metal or plastic cans equipped
with flyproof covers. All garbage stored in such cans shall be wrapped
and drained of water and other fluids. No garbage can shall exceed
32 gallons in capacity and must be equipped with suitable handles
for easy handling.
B.
Loose refuse must be boxed or placed in a container.
If a container is reusable, it must be equipped with handles for easy
handling, and it must not exceed 32 gallons in capacity or 150 pounds
in weight. No individual item of unboxed rubbish or rubbish not placed
in a container shall exceed the dimensions of one foot by two feet
by three feet or weigh more than 150 pounds.
C.
Ashes shall be cooled and placed in a container. Any
container containing ashes shall be equipped with handles for easy
handling, and such ashes and the container shall not exceed 150 pounds
in weight.
