Where it shall be necessary and expedient for the preservation of the public health, safety, general welfare or to eliminate a fire hazard, an owner or tenant of real property within the Borough of Barnegat Light shall remove from such lands brush, weeds, dead and dying trees, stumps, roots, obnoxious growth, filth, garbage, trash and debris within 10 days after notice to remove the same from the Borough.
If an owner or tenant who has received notice in accordance with the provisions of § 66-1 fails or neglects to remove from said lands the brush, weeds, dead and dying trees, stumps, roots, obnoxious growth, filth, garbage, trash and debris or fails to cut any brush, hedges, shrubs or other obstructions for which said person was notified within 10 days of the same, then, and in that event, the Borough shall have the right to provide for the removal of the same by or under the direction of an officer of the municipality.
In all cases where any brush, weeds, dead and dying trees, stumps, roots, obnoxious growth, filth, garbage, trash and debris are removed or any brush, hedges, shrubs or other obstructions are cut by the Borough under the provisions of this chapter, the officer of the municipality in charge of the removal of said material shall certify the cost thereof to the governing body. Upon receipt of the certificate of cost, the governing body shall examine the same and, if found correct, shall cause the cost as shown thereon to be charged against the property from which said material was removed. The amount so charged shall become a lien upon such lands and shall be added to and become and form part of the taxes next to be assessed and levied upon said lands, the same to bear interest at the same rate as other taxes, and shall be collected and enforced in the same manner as taxes.

No person shall remove or cause the removal of any brush, weeds, grass, or other vegetation, on any public property located west of Bayview Avenue, within the Borough of Barnegat Light. In exceptional circumstances the Mayor and Borough Council may, in its sole discretion, grant a waiver from the prohibition of this section by resolution, upon written application of an aggrieved party specifying the exceptional reasons for the proposed removal, the area to be removed and the manner in which the cuttings will be disposed of.

A. 
The in-ground planting of bamboo plants is prohibited in the Borough of Barnegat Light.
B. 
Regulation of and limitations on existing bamboo plants.
(1) 
All property owners must control the growth of bamboo plants on their property. Failure to control and/or prevent the spread of such vegetation beyond the boundaries of any property within the Borough is a violation of this section.
(2) 
All existing bamboo plantings must be contained by appropriate physical barriers to prevent growth or spread beyond the boundaries of a resident's property.
C. 
Removal of bamboo plants. In the event invasive bamboo plant(s) are present on any plot of land, or any other premises or place in the Borough, the Borough shall serve written notice to the property owner to remove or abate the violation within such time as shall be specified in such notice. The cost of abatement shall be borne by the property owner. If the owner fails to comply with such notice within the time period specified to therein, the Borough may remove or otherwise control the plant(s) and recover the cost of such removal/control from the property owner and place a lien on the property to recover the cost of said removal.
D. 
Penalty. A violation of this section shall be punishable as provided in Chapter 1, General Provisions, § 1-15. A continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of such violation will be punished as provided above for each separate offense.

A violation of this chapter shall be punishable as provided in Chapter 1, General Provisions, § 1-15. In addition, any person who violates this chapter shall be required to reimburse the Borough for any and all fines, costs, assessments, or other penalties imposed upon the Borough as a result thereof by other governmental agencies.
