The Board of Health as heretofore established and functioning in the Borough of Berlin pursuant to and in accordance with N.J.S.A. 26:3-1 et seq. be and the same is hereby continued, subject, however, to the provisions of this chapter.

The Board of Health of the Borough of Berlin shall consist of five members and shall be appointed by the Mayor and confirmed by the Borough Council; except as herein provided, they shall serve for terms of three years. The terms of not more than three members shall expire in any one year, except in the case of vacancies, which shall be filled for the unexpired term only.

The Board of Health shall adopt rules and regulations for its own government; it shall elect a Chairman and a Vice Chairman from among its own members.

A. 
The Board of Health shall appoint, subject to the necessary fiscal appropriation, as limited and set forth in § 25-5, a Clerk or Secretary and, subject to the foregoing, appoint such other officers, assistants or employees as it may deem necessary. All such appointees shall be governed by the rules of the Board of Health and may be removed for cause by said Board.
The Board of Health shall not contract liabilities of any kind beyond the amount permitted and allowed by law, except on appropriation made for its use by the Mayor and Borough Council of the Borough of Berlin.
