No person, firm or corporation shall hereafter install and operate equipment for the burning of fuel oil or the storage of oil in connection therewith, or for the burning of gas, either natural or manufactured, for heating purposes in any building in the Borough of Berlin, without first obtaining a permit therefor as is hereinafter provided.
No such permit shall he issued except for the use of oil-burning equipments and/or gas-burning equipments tested and listed by the Underwriters' Laboratories and installed in accordance with the regulations for the installation of such equipment and for the storage and use of fuel oil in connection therewith as recommended by the National Fire Protection Association and approved by the Middle Department Rating Association.
Any person, firm or corporation desiring such permit shall make application in writing to the Borough Fire Marshal, stating the make of such equipment, by whom manufactured, the location in the Borough where it is proposed to install the same, and the method of the proposed installation, which application shall be accompanied by a fee of $3 for each oil-burning equipment or gas-burning equipment, and additionally, a fee of $2 for each tank for the storage of fuel oil, which fees shall be paid to said Fire Marshal. Immediately after the installation of such equipment, it shall be inspected by said Fire Marshal, and if found to comply with the provisions of § 179-2 hereof, he shall endorse his approval on said application and deliver to the applicant or the owner of the building a permit signed by him authorizing the operation of the said oil-burning equipment and/or gas-burning equipment as installed. No such equipment so installed shall be placed in operation, except to test the same, until such permit shall have been obtained.
The Borough Fire Marshal may, at any time, reinspect the equipments installed under the provisions of this chapter, and shall revoke the permit where dangerous conditions are found. lie may also at any time inspect oil-burning equipments and/or gas-burning equipments installed prior to the enactment of this chapter, and if, in his judgment, any such equipments are of such character or so installed as to create a fire menace, he shall prohibit their operation until such condition is remedied in which case they shall not be operated thereafter until a permit is secured as provided herein.
Any person or persons, firm or corporation violating any of the provisions of this chapter shall, upon conviction thereof, be subject to a fine of not exceeding $100 or imprisonment for a term not exceeding 30 days, or both. Each day that such violation shall continue shall be deemed a further and separate offense under the terms of this chapter, subject to the penalties herein prescribed.
