The parking of vehicles shall be prohibited, except as set forth herein,
in the municipally owned parking area bounded by White Horse Pike and Haines
Avenue and, in addition to being subject to the laws of the State of New Jersey,
shall be subject to all of the regulations and provisions contained in this
article.
It shall be unlawful for any person, firm or corporation to park or
cause to be parked or to permit his, her or its agent or servants to park
any vehicle or vehicles at any time in the parking area bounded by White Horse
Pike and Haines Avenue, except as set forth herein:
A.
Parking shall be permitted for Borough of Berlin employees,
appointed and elected officials, New Jersey employees employed at the Driver
Qualification Center, tenants of the Borough of Berlin and said tenants' employees
between the hours of 8:00 a.m. and 5:00 p.m., Monday to Friday, inclusive,
in such spaces as may be set aside and designated from time to time by the
Chief of Police of the Borough of Berlin and as may be reasonably necessary
to accommodate the needs of the Borough employees and officials and state
employees and Borough tenants and said tenants' employees.
B.
All of the remaining spaces in said parking area shall
be limited to two-hour parking by the public at large between the hours of
8:00 a.m. and 5:00 p.m., Monday to Friday, inclusive. At all other times,
parking shall be limited to four hours for the public at large.
C.
All eligible persons shall obtain a parking permit from
the Berlin Borough Clerk before being able to park in said parking area. The
permit shall be affixed to the vehicle in accordance with instructions and
requirements of the Police Department of the Borough of Berlin.
It shall be unlawful and a violation of this article for any person
to permit any vehicle to be parked in said parking area other than within
the boundary lines of a designated parking space or for a time period greater
than that established in this article. It shall also be unlawful and a violation
of this article for any person to wash, paint, repair or otherwise work on
or in any such vehicle; provided, however, that nothing herein contained shall
be construed to prohibit necessary emergency repairs to a vehicle.
The Police Department may remove from the aforesaid parking area any
unattended vehicle parked or standing in any portion of said parking area
not designated as a parking space or any unattended vehicle parked or standing
in a designated parking space which has remained in said designated parking
space for a period of 10 hours after a summons has been issued charging a
violation hereunder. When a vehicle is so removed from said parking area,
the owner of said vehicle shall pay, before being entitled to the recovery
or possession of said vehicle, all reasonable charges for towing, storage
and other expenses incurred in the removal of said vehicle.
A.
Enforcement procedures.
(1)
The provisions of this article shall be enforced by the
Police Department of the Borough of Berlin and also as contemplated and permitted
by law.
(2)
The Police Department and the governing body of the Borough
of Berlin shall cause to be erected suitable and proper markers and signs
in the area affected by this article in compliance with the laws of the State
of New Jersey.
B.
Any person, firm or corporation violating any of the
provisions of this article shall be subject to a fine of not more than $50
or to imprisonment for a term not to exceed 15 days, or both, at the discretion
of the court tribunal.

The parking of motor vehicles shall be permitted, except as provided
herein, in the municipally owned parking area located on Rich Avenue in the
Borough of Berlin.
The following acts are hereby prohibited on the Rich Avenue Parking
Lot:
Any person who shall violate the provisions of this article shall, upon
conviction, be punished by a fine not exceeding $500 or by imprisonment not
exceeding 30 days, or both, in the discretion of the court.
