For the purpose of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
ASHES
The residue from combustion of any type of solid fuel, such as wool, coal, coke, charcoal, paper or any similar substance.
BOROUGH
The Borough of Berlin in the County of Camden and State of New Jersey.
CART
The specially designed solid waste receptacle provided by the Borough in either the ninety-five-gallon or sixty-five-gallon capacity.
GARBAGE
Any waste material in the process of or subject to decomposition or decay incident to ordinary domestic business use or purpose, including, among other things, kitchen refuse, animal or vegetable matter, offal and decaying or decomposing substances.
GARDEN REFUSE
Small branches of trees; hedge, bush and vine trimmings; stalks of vegetables and plants, grasses, weeds and similar substances or materials found in residential yards; but not leaves in bulk, tree roots, tree trunks or portions thereof, or large tree branches.
OCCUPANT
The owner, tenant, lessee, caretaker or any other person in charge of any residential premises affected by this article, whichever classification may be appropriate and effective for its enforcement.
SOLID WASTE
Includes all ash, garbage, garden refuse, trash, rubbish and waste normally collected by the Borough or its authorized agents.
TRASH and RUBBISH
All miscellaneous materials such as rags, paper products, cardboard, leather goods, cartons, rubber, bottles, tin cans, broken glass, crockery or any similar materials or substances, but not logs, earth, sand, bricks, mortar or other substances which may accumulate from building operations.
The Mayor and Borough Committee shall have the right and power by resolution to grant the exclusive privilege of removing and transporting solid waste within the corporate limits of the Borough, in the county and state, or to otherwise provide therefor.
The collection and removal thereof shall be done in accordance with the provisions of these rules and regulations and shall be subject to the general supervision of the Mayor and Borough Committee and the Board of Health and shall be subject to such additional rules and regulations as the Mayor and Borough Committee and the Board of Health may from time to time prescribe by resolution.
A. 
The Borough will provide one cart to each homeowner in the Borough and such carts as are necessary to each apartment complex and/or condominium association located within the Borough.
B. 
All carts shall remain the property of the Borough. In the event that any homeowner shall move from his/her residence, the cart shall be left on the property.
C. 
All carts must be set by the occupant in front of the premises at the curb or on the edge of the street with the arrows on the lid pointing toward the street, after 4:00 p.m. of the preceding day and prior to 6:00 a.m. of collection day. The cart must be placed with four feet of clearance on all sides to allow for safe and proper collection. The cart must be removed from the street or curb no later than 6:00 p.m. on the day of collection.
D. 
The occupant of the premises shall keep the cart clean and in a proper condition for safe handling.
E. 
Bulk trash pickup is the first full week of each month that begins on a Monday with no holidays during the week. Bulk trash can be placed curbside after 4:00 p.m. of the preceding day and prior to 6:00 a.m. of collection day. If bulk trash is placed curbside prior to 4:00 p.m. of the day preceding pickup, the occupant shall be subject to a fine not exceeding $100 for each day of the violation.

F. 
Property owners shall be charged a fee of $65 for each additional or replacement cart.

A. 
No garbage shall be placed for collection in bags, boxes or corrugated receptacles. All garbage shall be thoroughly and completely drained of all liquids, wrapped securely in paper and placed in the cart, as defined hereinabove, with other trash.
B. 
All other materials and/or substances referred to herein shall be stored and held in the cart, as defined herein, whenever possible. No solid waste of any nature which is outside of the cart will be collected by the Borough.
A. 
The Borough will collect solid waste from owner-occupied businesses provided the owner-occupant of such business complies with the requirements of § 278-9 hereof. Any owner-occupant of a business will be permitted to set out up to three carts, as defined above, for solid waste collection by the Borough.
B. 
The owner-occupant of any such business may purchase his/her carts from the Borough. The price for such cart(s) shall be set by the Borough by resolution.
C. 
The owner-occupant of any business may select to have the Borough collect its solid waste from a three-cubic-yard container which meets the specifications set by the Borough.
It shall be unlawful for any person to:
A. 
Place or store any of the substances and/or materials referred to in this article in any paper bag, parcel, wooden keg or barrel, basket, drum or any type of container whatsoever other than the type of receptacle herein specified.
B. 
Collect, pick up, rake or in any other way disturb the substances and/or materials referred to in the article when deposited in receptacles or otherwise and laid or placed on any curb, street or public place for collection; provided, however, that this Subsection B shall not apply to authorized officials, including, but not limited to, authorized sanitation personnel or fire fighters or law enforcement officers in the performance of their respective official duties.
C. 
Violate any other term, condition or requirement of this article.
In the collection, removal and disposal of substances and/or materials hereunder, all the provisions of these rules and regulations and all provisions of any other ordinance or regulation of the Borough Committee or of any state or federal law or regulation which may pertain to the subject matter shall be fully and completely complied with.
