This chapter shall be known and designated as
"The Sanitary Code of the Borough of Berlin."
As used in this chapter, the following terms
shall have the meanings indicated:
The Board of Health of the Borough of Berlin.
The thorough removal of dust and other contaminating material
in such a way as to prevent the entry thereof, as far as may be possible,
into other rooms or dwellings; washing with soap and hot water; scouring,
airing and exposure to sunlight.
Any chemical substance or agent which will destroy microorganisms.
Includes all confectionery and every article used for food
or drink by man, and every ingredient in any such article.
The separation of persons or animals suffering from a communicable
disease, or of a carrier of the infectious organisms, from other persons
or animals, in such places and under such conditions as will prevent
the direct or indirect conveyance of the infectious agent to other
persons.
A written authorization granted in its discretion by the
Board or its agent duly authorized so to do, upon payment of the required
fee, permitting the conduct of a designated business or the performance
of specified acts for the period stipulated and in strict accordance
with the provisions of this code and the New Jersey State Sanitary
Code.
Temporary permission in writing to cover the doing of a single
act or a series of acts and may be revoked by the Board at any time
although the act or acts for which the permit was granted have not
been completed.
Includes both the singular and the plural, and shall include
individuals, associations, clubs, partnerships, corporations, institutions
and all other bodies of persons associated for any purpose whatever.
The confining of persons, animals or materials within a designated
area and excluding other persons, animals or materials therefrom.
No person shall interfere with or obstruct in
any manner the entrance upon any premises or into any building, or
the inspection and examination of any person or premises, by any member
of the Board of Health, the Health Officer, Sanitary Inspector or
any person acting under and by the authority of the Board of Health,
in the discharge of his duties under this code or the New Jersey State
Sanitary Code.
A.
The Board shall have power to revoke any permit or
license whenever the holder thereof or any of his servants or agents
violates the terms thereof or under which the same was issued. Before
any permit or license shall be revoked, a notice of the proposed action
shall be served upon the holder thereof, setting forth the charges
that constitute the reason for such action, and the place, date and
hour when the Board will conduct a hearing thereon.
B.
Whenever any permittee or licensee shall violate the
terms under which said permit or license was issued, the Board or
the Health Officer shall have the right to suspend the operation thereof
pending such hearing.
All licenses or permits shall be prominently
displayed upon the premises for which they were issued; and upon each
and every vehicle or device used in the business for which a license
is required, there shall be displayed at all times in plain sight,
a current license sign to be furnished by the Board.
