All words used in this chapter shall carry their customary meanings except where specifically defined herein. Words used in the present tense shall include the future. The singular number shall include the plural and the plural, the singular. The word "shall" is always mandatory and not permissive; the word "may" is permissive. The words "used" or "occupied," as applied to any land or structures, shall be construed to include the words "intended, arranged, designed to be used or occupied." The word "person" shall include an individual, corporation, partnership, incorporated association or any other entity. Words in the masculine gender shall include the feminine gender.
The following words and phrases shall have the particular meaning specified for the purpose of this chapter:
ABANDONED VEHICLE
A vehicle not registered or licensed and which is not in normal use, which has been abandoned for such purposes.
ANTIQUE VEHICLE
A vehicle, but not a reproduction thereof, manufactured more than 25 years prior to the current year and which has been maintained in or restored to a condition which is substantially in conformance with manufacturer specifications, and is registered and licensed as such.
AUTHORIZED AGENT OF THE TOWNSHIP
A Township Supervisor, Zoning Officer, police officer, or their appointed representatives.
AUTOMOTIVE VEHICLE
A car, truck, motor home, motorcycle, or like conveyance normally used for transporting persons or materials either on or off roads.
BOARD
The Board of Supervisors of Allegheny Township, Westmoreland County, Pennsylvania.
BUSINESS
Construction and construction-related, retail, fabricating, repair, service or manufacturing enterprises, but not limited to these.
BUSINESS VEHICLE
Any vehicle which is exclusively used in the conduct of a "for profit" or "not for profit" enterprise.
CLASSIC VEHICLE
A vehicle, but not a reproduction thereof, manufactured more than 10 years prior to the current year and which has been maintained in or restored to a condition which is substantially in conformance with manufacturer specifications, and is registered and licensed as such.
COMPOST
A mixture consisting largely of decayed organic matter which is used for fertilizing and conditioning land.
COVER
A tarpaulin or like item which is normally used to cover objects and protect them from weather.
DAY
The twenty-four-hour time period occurring between 12:00:00 midnight of a particular calendar date and 12:00:00 midnight of the next, consecutive, calendar date.
DUMPING
The intentional, unauthorized act of depositing, placing or scattering junk, garbage, animal feces or offal, or other discards, alongside of federal, state, county and Township roads or within 100 feet of either road shoulder on properties, private or otherwise, which adjoin said roads, by a person who does not normally reside upon said property.
JUNK/SALVAGE
Any discarded material such as metal, paper, rags, or anything that is regarded as worthless, meaningless, contemptible, or mere trash, which shall include both organic and inorganic material.
JUNK/SALVAGE DEALER
Any person who buys, sells, collects, sorts, stores, or in any way deals in junk or owns, leases, operates or maintains a junkyard within the Township.
JUNKYARD
A business enterprise involving the collection, storage, processing, recycling, and/or sale of scrap metal other than household recyclable materials, scrapped, abandoned, or junked motor vehicles, machinery, construction, or other equipment or parts.
NONRESIDENTIAL DISTRICT
Any zoning district which is not an R1, R2, R3, or RC District as defined by the Allegheny Township Zoning Ordinance.[1]
NUISANCE
Anything which is injurious to health, or is indecent or offensive to the senses, or an obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property, or which unlawfully obstructs any public park, square, street or highway.
OPERABLE
Capable of being used for its original intended purpose.
OWNER
The person to whom a vehicle legally belongs.
PERMIT
A license issued by the Board which allows for accumulation, storage, and disposal of salvageable or unsalvageable material, junk, rubbish, or scrap materials in accordance with this chapter.
PERSON
Any natural person, partnership, firm, corporation or other legal entity, including singular and plural, male and female.
PLANNING COMMISSION
The Planning Commission of Allegheny Township, Westmoreland County, Pennsylvania.
POSSESSOR
The person to whom junk or salvage material immediately belongs or who normally resides upon the property where said material is located.
PREMISES
Any parcel of land situated in Allegheny Township, Westmoreland County, Pennsylvania having a separate tax map parcel number for county assessment purposes.
PROPERTY OWNER
The person holding legal title or deed to the property upon which junk material is located.
RECREATIONAL VEHICLE
Any vehicle used primarily for pleasure and amusement and which is not an automotive vehicle or trailer.
RESIDENT
A person who resides in Allegheny Township, or a business or organization having its principal building within the boundaries of Allegheny Township.
RUBBISH
All discarded metal, plastic, glass, ceramic, and organic materials; pasteboard; rags; mattresses; discarded furniture or appliances; discarded clothes, shoes and boots; leather; carpets; broken glass; crockery; bottles; excelsior; floor sweepings; metal packing boxes and barrels and broken parts thereof; cans; tires; household refuse generally including garbage; nonsalvageable demolished building materials; and any other material which by reason of its nature might give off toxic chemicals, obnoxious odors or dust or be unsightly or a fire hazard or harbor rats, vermin, insects or termites to the detriment of the health, safety or general welfare of the residents of Allegheny Township.
SALVAGE YARD
Any location where a salvage dealer conducts his business.
SCRAPPING
The act of removing various components from a vehicle and offering them for sale, or delivering said components, including the entire vehicle, to a junk or salvage yard.
SHIELDING
Fencing, vegetation, a building or other opaque structure which acts to prevent a vehicle from being seen.
TOWNSHIP
The Township of Allegheny, Westmoreland County, Pennsylvania.
TRAILER
Any vehicle which is designed to be towed by a separate, powered vehicle and which is not self-propelled.
VEHICLE
Every device in which, upon which, or by which any person or property is or may be transported or drawn upon a highway, and is ordinarily required to be currently registered with the Commonwealth of Pennsylvania or any other state, except devices used exclusively upon rails or tracks.
VEHICLES-IN-USE
Any vehicle(s) in which displays all Pennsylvania state required markings or required markings by another state and is in normal use by its owner(s), including antique vehicles and classic vehicles.
VEHICLES PER PROPERTY
The number of vehicles kept or stored upon a particular property.
ZONED DISTRICT
Any land and water area within the Township so defined by the approved Township Zoning Map.
