No person shall sell, expose or offer for sale, use, keep, discharge or explode any fireworks, as defined by the Wisconsin Statutes, within the Village, except as provided in § 167-2 of this chapter.
A. 
Permit for commercial display. Fireworks, other then those prohibited by federal and state laws, may be used by public authorities, fair associations, amusement parks, park boards, civic organizations, businesses or licensed pyrotechnicians that have been granted a permit for public display by the Village President. Applications for permits shall be filed in writing with the Village Clerk-Treasurer, who shall refer such applications to the Village President. Before any permit for a commercial display of fireworks shall be granted to any applicant, the applicant shall file with the Village Clerk-Treasurer:
(1) 
A certificate of insurance for an amount no less than $1,000,000 liability coverage with the Village of Balsam Lake named on the certificate of insurance for the payment of all claims that may arise by reason of injury to persons or property from the handling, use of and discharge of fireworks under such permit.
(2) 
A copy of the pyrotechnician's license.
B. 
Permit for personal display. A copy of a homeowner's insurance policy is required to be filed with the application for the permit.
C. 
Restrictions on granting permits. No permit shall be granted for the display of fireworks within 70 feet per inch of shell of any gasoline pump, filling station or bulk station, or any building in which gasoline or volatile liquid is sold in quantities in excess of one gallon.
Except as otherwise provided, any person who shall violate any provision of this chapter shall be subject to a penalty as provided in Chapter 1, § 1-4, of this Code.
