[HISTORY: Adopted by the Village Board of the Village of Belgium at time of adoption of Code (see Ch. 1, General Provisions, Art. II). Amendments noted where applicable.]
No person, firm or corporation shall build any outdoor fire within the corporate limits of the Village of Belgium, except as set forth in § 108-2 below.
A.
The following may be permissible:
(1)
Outdoor cooking over a non-wood-burning fire fueled by charcoal or propane gas contained in a device or structure designed for such use.
(2)
Campfires in a covered or other approved container at least 10 feet away from all combustibles, buildings, decks and lot lines.
(3)
Controlled burning of grass or similar vegetation for environmental management purposes, with the prior written approval of the Fire Chief.
(4)
Ceremonial campfire or bonfires, with prior written approval of the Fire Chief.
B.
Other occasions of desirable outdoor burning not specified by this section, but not as an alternative to refuse removal or disposal for which other methods may be available, may be granted single-occasion approval as in Subsection A(3) and (4) above.
C.
Whenever approval and special permits are granted by the Fire Chief, the permit shall be granted only after an on-site inspection, consideration of any hazards that could affect adjacent property and observance of any safety restrictions that the Fire Chief may require. A fee as set by the Village Board shall be paid to the Village of Belgium for each permit issued.
The Fire Chief is permitted to prohibit any open burning when atmospheric conditions or local circumstances make such fires hazardous, except on written permit from the Fire Chief, which permit shall designate the time and place for such burning. Notice of designation of a fire danger emergency period shall be made by publication of an appropriate order to be effective forthwith.
No materials may be burned upon any street, curb, gutter or sidewalk.
Persons utilizing and maintaining outdoor fires shall be responsible for any liability resulting from damage caused by such fires.
In addition to any other remedies provided by this chapter, any person violating any provision of this chapter shall be subject to a penalty as provided in Chapter 1, § 1-5 of this Code.
