The purpose of this chapter is to further implement the powers and execute the responsibilities of the Town of New Canaan under the Connecticut General Statutes and under its Charter, particularly, but without limitation, Charter § C1-3(9) relating to the regulation of the design, construction and use of buildings within the town.
A. 
No improvement shall be constructed on any real property of which the town is the record owner, nor shall any improvement whatsoever be constructed by authority of any board or agency, the capital or operating budget of which is contained in appropriations which must be approved by the Town Council, unless the Town Council shall have first approved the construction of such improvement. Approval by the Town Council of an appropriation for the construction of an improvement shall be deemed to satisfy the requirements of this chapter.
B. 
Owners of private property, within one hundred feet of any municipal property on which such an improvement is proposed to be constructed, shall be given prior written notice of the proposed improvement and the date that such matter will be heard by the Town Council, which notice shall be mailed at least 10 days prior to the Town Council hearing.

Approval by the Town Council as contemplated by this chapter shall be subject to such conditions as the Town Council may impose. Without limitation, such conditions may include:
A. 
The approval of such town boards or commissions as may be specified.
B. 
The submission of a satisfactory plan for financing the maintenance and preservation of the proposed improvement.
If any portion of this ordinance shall be invalidated as contrary to law, the remaining portion shall remain in force.
This ordinance shall become effective upon adoption in accordance with Town Charter.
