A.
All claims seeking monetary damages from the Town of Stratford, except
those related to workers' compensation claims, shall be filed with
the Town Attorney's office, which shall request and/or conduct an
investigation into the merits of each such claim.
B.
All notices of intent to sue the Town filed in the Town Clerk's office
pursuant to the requirements of the Connecticut General Statutes,
and all writs, summons and complaints constituting legal action against
the Town, shall be immediately forwarded by the Town Clerk's office
to the Town Attorney's office for consideration in accordance with
the terms of this article.
Upon completion of the investigation requested and/or conducted
by the Town Attorney's office, the Town Attorney or an Assistant Town
Attorney assigned to the particular claim, in consultation with the
Town Administration, shall have the authority to compromise or settle
any claim against the Town of Stratford, including sewer claims, which
claim does not exceed the amount of $50,000. A report shall be provided
monthly by the Town Attorney's office to the Town Council and/or Water
Pollution Control Authority as to the status of claims against such
body resolved in accordance with this section. Any member of the Town
Council and/or Water Pollution Control Authority may request that
further consideration be given to any claim which has been denied
by the Town Attorney's office.
A.
Claims against the Town. Any claims, except claims under § 14-46B below, in excess of $50,000 and processed in accordance with this section shall be referred by the Town Attorney's office to the Town Council for a final consideration or vote; provided, however, that any such claim in excess of $50,000 which is to be paid, settled or compromised must be approved by the Town Council.
B.
Claims against the WPCA. All claims against the WPCA in excess of
$50,000 and processed in accordance with this section shall be referred
by the Town Attorney's office to the Water Pollution Control Authority
for a final consideration or vote; provided, however, that any such
sewer claim in excess of $50,000 which is to be paid, settled or compromised
must be approved by the Water Pollution Control Authority.
