The Director of Health shall administer and enforce the air pollution control regulations, Article II, of the Town of Stratford.
The Director of Health may promulgate air pollution
control regulations particularly applicable to the Town of Stratford,
and such regulations shall be adopted by the Town Council in the same
manner as are adopted ordinances of the Town. The Director of Health
shall publish such regulations and all amendments thereto and shall
distribute the same to persons requesting copies thereof.
A.Â
The Mayor shall designate an Air Pollution Control
Officer or Officers, who may also be an employee of the Department
of Health, to make such instructions and investigations as are necessary
to administer and enforce air pollution control regulations of the
Town. The Air Pollution Control Officer or Officers is authorized
to enter private property for the purpose of making inspections and
investigations to correct a violation of air pollution control regulations.

The Air Pollution Control Officer or Officers may,
in the name of the Town, enforce air pollution control regulations
by injunction or other appropriate civil remedy, except that no action
predicated on a violation of air pollution control regulations shall
commence unless the Air Pollution Control Officer shall first serve
written notice of violation on the person violating a regulation,
which notice shall specify the reasonable opportunity to correct such
violation, except that in the case of a violation which constitutes
a clear and present danger to human health, the Air Pollution Control
Officer may act summarily by an order to cease and desist, which order
may be served and enforced by a police officer of the Town of Stratford
and which order may be accompanied by a warrant for the arrest of
the violator.

Any person who violates any provision of this article
or the regulations promulgated hereunder, or who shall hinder, obstruct,
delay, resist, prevent or in any way interfere with the Air Pollution
Control Officer's enforcement of this article, shall be guilty of
a misdemeanor, punishable as hereinafter set forth.
B.Â
Any person convicted of violating any portion of this
article or the regulations promulgated hereunder shall be guilty of
a misdemeanor and shall be fined not more than $100 or imprisoned
for not more than 30 days, or both, for each offense. Each day that
a violation continues shall constitute a separate offense punishable
by a fine of $100 or imprisonment for not more than 30 days, or both,
for each offense.
