As used in this chapter, the following terms shall have the meanings indicated:
ALARM DEVICE
Includes any machine or instrument that is capable of sensing an intrusion into a building or a fire in a building in which automatically causes a transmission or relay or results in the transmission or relay of a warning or message to the Police or Fire Department.
A. 
No person in control of a building shall install an alarm device in a building under his or her control without obtaining a permit from the Building Inspector.
B. 
A person, corporation, business or other commercial enterprise shall designate a permittee as a responsible party for fines authorized under this chapter. Such permittee shall provide proof of financial responsibility before a permit may be issued.
C. 
A permittee must notify the Police or Fire Department 10 days before the installation of any alarm device in a building and present a copy of the permit issued by the Building Inspector at the time of said notice.
D. 
Any person, corporation, business or commercial enterprise found in violation of any provision of this section shall be fined no less than $25 and no more than $100.

A. 
A false alarm includes any transmission or relay of a message, signal or warning to police or fire authorities caused by error, mechanical or otherwise, or malfunction of an alarm device or resulting from the test of such alarm device without prior notice to Police or Fire Department officials.
B. 
Any person, corporation, business or commercial enterprise who is found to have come in violation of the above provision of this section on three occasions within the period of one year shall be fined $100 for each violation thereafter.
C. 
A person who is designated as a permittee under § 46-2 of this chapter is responsible for the proper maintenance and function of any alarm device and shall be responsible for the payment of any penalty or fine authorized under this section.
D. 
A Stratford ordinance violation ticket shall be issued by an authorized member of the Police Department for each violation of this section, which requires said fine to be paid within 72 hours of issuance. If the violator fails to pay the fine or elects to plead not guilty, a state infraction summons to Superior Court shall be issued, and interest shall run on the unpaid balance at the rate of one and one-half percent (11/2%) per month.
E. 
The Chief of Police shall formulate a process by which anyone aggrieved by the issuance of such an ordinance violation ticket can request a review of the same. The party to whom the ticket is issued shall be notified of the process at the time of the issuance of said ticket. If a review is requested in accordance with the process, the time requirement regarding payment of the fine shall be stayed until final determination of the review requested.
An alarm device that is capable of sending a message, code, signal or prerecorded voice message automatically shall not be connected to any phone line terminating in the Stratford Police Department.
A. 
A person, corporation or commercial enterprise engaged in the business of installing or servicing alarm devices shall obtain a permit to conduct such business from the Building Inspector. No alarm device may be installed before obtaining such permit.
B. 
Any such person, corporation or commercial enterprise shall designate a permittee responsible for fines authorized under this section and provide proof of financial responsibility before such permit is issued.
C. 
No person, corporation or commercial enterprise shall install or cause to install an alarm device in any building without ascertaining that a permit for such installation has been obtained by any person in control of said building.
D. 
Violation of any provision of this section shall result in a fine of no less than $100 for each violation.
A person, corporation or commercial enterprise shall be subject to penalties imposed under § 46-3 of this chapter under the following conditions:
A. 
When the person, corporation or commercial enterprise fails to inform Police or Fire Department officials before the test of such alarm devices.
B. 
When the person, corporation or commercial enterprise is aware of a malfunction or failure in an alarm device or system which is likely to cause a false alarm and fails to notify police or alarm officials.
