Three-wheel and four-wheel all-terrain motor vehicles are banned from the streets, sidewalks, and other public lands including public beaches, dunes, and other sensitive habitat areas, except as necessary to provide for the health or safety of persons, wildlife or property by persons operating such vehicles in an official capacity.
Persons who are caught operating ATVs and all non-street-legal vehicles as deemed by the Department of Motor Vehicles, such as mini-motorcycles, on public property or private property where the operator of said vehicle does not possess written authorization from the owner of the private property, within the Town of Stratford shall be guilty of a misdemeanor and shall be subject to the following fines and action:
A. 
Offense No. 1 and all subsequent violations: A fine of $100 to the operator of the vehicle. The ATV and all non-street-legal vehicles as deemed by the Department of Motor Vehicles, such as mini-motorcycles, shall be impounded by the Stratford Police Department for a period of 48 hours after which the owner must pay the fine as well as any transportation and storage costs associated with the vehicle. If the fine and associated transportation/storage costs are not paid within 90 days of impounding the vehicle, it shall be sold at public auction for fine relief.
Signs shall be posted in all large public open space land areas and any area designated by the Mayor. These signs shall warn all that ATV and all non-street-legal vehicles as deemed by the Department of Motor Vehicles, such as mini-motorcycles, activity is prohibited on public property. Lack of signage shall not be grounds for waiver of the misdemeanor charges or fines.
