Editor's Note: This chapter was derived from
Sections 4.21 through 4.26 of the Town of Yarmouth Bylaws. Sections
4.21, 4.22, 4.23 and 4.26 were originally adopted in 1915. Section
4.24 was originally adopted in 1915 and amended 4-9-1974. Section
4.25 was originally adopted 2 19-1914 and amended 4-9-1974.
The Treasurer is authorized to engage counsel
at the expense of the Town for the purpose of prosecuting any action
at law under the provisions of the public statutes relating to suits
on bonds, notes or other securities and for trespasses committed on
any public buildings or enclosures belonging to the Town, but no bill
shall be paid by the Treasurer for services of counsel so employed
until it has been approved by the Selectmen or a majority of the same.
The Treasurer shall render a classified statement
of all expenditures and receipts of the Town in such detail as to
give a fair and full exhibit of the objects and methods of all expenditures.
No moneys shall be paid by the Town Treasurer
unless upon an order signed by the Selectmen or a majority of the
Board of Selectmen, except as is otherwise provided by law, by these
bylaws or by a vote of the Town.
At the close of every fiscal year, the Treasurer
shall render his account to the Selectmen and shall account with them
for all money received and paid by the Treasurer in behalf of the
Town.
All Town boards, committees and officers shall,
on or before the 30th day of June in each year, settle their accounts
and pay to the Treasurer all moneys due the Town.
Any person indebted to the Town for poll tax
or otherwise shall have such debt deducted by the Treasurer or Selectmen
before payment is made for any sum due said person from the Town for
work or service performed in any department of the Town.

The Town Treasurer, with the approval of the
Board of Selectmen, is authorized to sell at public sale any real
estate the Town may acquire by tax title foreclosures and takings
and give proper deeds therefor. The sale of any Town property so acquired
must have a minimum sale price of no less than the assessed valuation
shown on the Yarmouth Assessors' records during the year of such sale.
