This chapter shall be known and may be cited as the "Consumer Protection Ordinance of the Township of Freehold."
The seller of any real property with a new home on it in the area defined below must include in the contract of sale a provision which states that the prospective buyer has been notified of the proximity of the subject property to all sanitary landfill operations which are in existence, proposed or which have been closed.
The area of Freehold Township in which such notification is required is defined by the area encompassed within a radius of 3,000 feet of all sanitary landfill operations which are in existence, proposed or which have been closed.
A new home shall be defined as one for which the initial certificate of occupancy is issued on or after the effective date of this chapter. This chapter shall not apply to any resales of said homes. This chapter shall not apply to any homes for which the original certificate of occupancy was issued before the effective date of this chapter.
Violations of the provisions of this chapter shall be punishable as provided in Chapter 1, Article II, General Penalty.
