A.
The
administrative functions, powers and duties of the City are allocated
and assigned among and within departments established or constituted
by this chapter as follows:
(1)
City Clerk.
(2)
Department of Administration and Finance.
(3)
Department of Law.
(4)
Department of Housing and Economic Development.
(5)
Department of Inspections.
(6)
Department of Public Works.
(7)
Department of Health and Human Services.
(8)
Fire Department.
(9)
Police Department.
(10)
Department of Water and Sewer.
B.
The
director of each department established by this chapter must be duly
qualified, by education, training, experience or certification within
the department field, to fulfill the duties and obligations of the
position of "director" of said department, as established under this
Code.

A.
Powers and duties. Under the supervision of the Mayor,
each department head shall:
(1)
Appoint subordinate officers and employees within
their respective departments and, with the approval of the Mayor,
remove such officers and employees subject to the provisions of the
Revised Statutes, Title 11, Civil Service.
(2)
Direct and supervise the work of the department and
its employees through the divisions established by this chapter.
(3)
Assign functions, powers and duties to subordinate
officers and employees within the department and modify such assignments
as need appears.
(4)
Delegate to division heads such of his/her powers
as (s)he may deem necessary for efficient administration.
(5)
Report at least annually to the Mayor and Council
in such form as shall be approved by the Business Administrator on
the work of the department during the preceding year.
B.
Compensation.
(1)
The salary range for the directors of departments
shall be as set by ordinance.
(2)
A director may serve as a division head, and a division
head may serve as a bureau head without additional compensation. Department
heads shall devote full time as required for the proper and efficient
discharge of the duties of their respective offices.
C.
Filling vacancies. Whenever a vacancy exists in the
office of head of any division by resignation, removal, disability
or otherwise, the director of the department may fill such vacancy
temporarily by appointing an acting head of such division who shall
have and perform all the functions, powers and duties of such division
until the office shall be filled permanently.
A.
Pursuant to the Charter, N.J.S.A. 40:69A-37 and 40:69A-43:
(1)
The Mayor, in his/her discretion, may remove any department
head after notice and an opportunity to be heard. Prior to removing
a department head, the Mayor shall first file written notice of his/her
intention with the Council, and such removal shall become effective
on the 20th day after the filing of the notice, unless prior thereto
the Council shall have adopted a resolution by a two-thirds vote of
the whole number of the Council disapproving the removal.
(2)
The Council may, for cause, remove any municipal officer
other than the Mayor or a member of Council.
(3)
The Council shall consider notices under Subsection A(1) above and motions under Subsection A(2) above only after notice and an opportunity to be heard are given to the affected officer. The Clerk shall forthwith cause a copy of the notice or motion, as the case may be, together with a statement of the charges involved and notice of the time and place fixed for hearing to be served personally, or by registered mail, upon the officer affected. The hearing shall be held not less than 10 days nor more than 15 days after the date of such service. The hearing shall be open to the public.
