A. 
It is required that all vehicles, including trucks, operated within the Village of Brewster be in good and safe operating condition, and each shall be operated only:
(1) 
While having a valid New York State certificate of inspection, or the equivalent thereof for any vehicle registered outside the State of New York, affixed on the vehicle in the proper location;
(2) 
While in full compliance with Article 9 of the Vehicle and Traffic Law of the State of New York, as amended, which article is fully incorporated herein by reference;
(3) 
While in full compliance with Article 10 of the Vehicle and Traffic Law of the State of New York, as amended, which article is fully incorporated herein by reference;
(4) 
While in full compliance with Article 6 of the Transportation Law of the State of New York, as amended, which article is fully incorporated herein by reference;
(5) 
While in full compliance with Article 21 of the Tax Law of the State of New York, as amended, which article is fully incorporated herein by reference;
(6) 
While properly registered in accordance with Article 14 of the Vehicle and Traffic Law of the State of New York, as amended, which article is fully incorporated herein by reference;
(7) 
While in full compliance with Article 49 of the Code of Federal Regulations, as amended, which article is fully incorporated herein by reference;
(8) 
No vehicle may operate within the Village of Brewster if that vehicle has been determined to be in an unsafe condition by a certified New York State inspector or by a person certified by the State of New York to conduct such inspections; and
(9) 
No vehicle may operate within the Village of Brewster if it has been determined that the vehicle should be put out of service by a New York State Department of Transportation inspector.
B. 
It shall be presumed that a violation of this section found through an inspection of a vehicle requested by an officer of the Brewster Village Police Department, Putnam County Sheriff's Department or New York State Police and inspected in the presence of any officer thereof; after the vehicle was involved in an accident, was a violation at the time of the accident. Any such inspection shall take place only after at least two days' notice is given to the owner of the vehicle, and the owner and/or person or persons designated by the owner shall have the right to attend the inspection.

A. 
Legislative findings.
(1) 
The Village of Brewster Board of Trustees has considered and deemed it advisable to enforce, via law enforcement authority, posted speed limits within the municipality of the Village of Brewster, New York.
(2) 
Given the immediate impact of the Village municipality infrastructure projects, such as the Village Stormwater Benefit Program and the Marvin Avenue Extension Project and the resulting traffic rerouting schemes required as a result of these projects, the modification of speed limits affected is an immediate necessity.
(3) 
The Village of Brewster Board of Trustees now deems it necessary for the health, safety and welfare of the Village residents to impose a new speed limit on the Village thoroughfare of Oak Street.
B. 
Definitions. As used in this section, the following terms shall have the meanings defined herein:
PUBLIC HIGHWAY
Any highway, road, street, avenue or public place, public driveway or any other public way.
ROADWAY
That portion of a highway improved, designed, marked or ordinarily used for vehicular travel exclusive of the shoulder and slope.
STREET
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
TRAFFIC
Pedestrians, ridden or herded animals, vehicles, bicycles and other conveyances, either singly or together, while using any highway for purposes of travel.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a street or highway, except devices moved by human power or used exclusively upon stationary rails or tracks.
C. 
Required obedience to traffic laws. It is unlawful and, unless otherwise declared in this section with respect to particular offenses, it shall be a traffic infraction for any person or motorist to violate the act required in this section. It shall be treated as a traffic violation pursuant to Article 30 of the New York State Vehicle and Traffic Law (VTL), incorporated by reference for purposes of this section.
D. 
Thoroughfare.
(1) 
The municipal thoroughfare for purposes of this section is the dedicated road known as "Oak Street."
(2) 
The thoroughfare runs easterly-westerly from the intersection of Oak Street and Main Street in the Village beginning at 137 Main Street, through the intersection of Oak Street, Hoyt Street and Prospect Street and ending at the intersection of Oak Street and North Main Street at 172 North Main Street.
E. 
Basic rule and maximum limit.
(1) 
No person shall operate/drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.
(2) 
Except as provided elsewhere in this Code, and except when a special hazard exists that requires lower speed for compliance with this section, no person shall drive a vehicle at a speed in excess of 20 miles per hour while driving/operating a motor vehicle on Oak Street.
F. 
Construction and interpretation. To the extent that any provision of this section is determined to be inconsistent with either New York State Village Law § 2-200 et seq. or Article 32 of the New York State Vehicle and Traffic Law, or any other provisions of those statutes as may be superseded pursuant to the Village's home rule powers, said provisions of the Village Law and Vehicle and Traffic Law are hereby superseded.
