GENERAL REFERENCES
Special police — See Ch. 40.
Pursuant to § 3-308, Subdivision 2, of the Village Law, a
separate Board of Police Commissioners is hereby established in the Village
of Garden City, consisting of three members.
A.
The members of the Board of Police Commissioners shall
be appointed by the Mayor of the village, subject to approval of the Board
of Trustees, one of whom shall be designated as Chairman.
B.
Notwithstanding any other provision of law to the contrary,
in lieu of any other residence requirement imposed by law, any member of the
Board of Police Commissioners may reside within the county in which the village
is located or in a county within the state contiguous to the county in which
the village is located.
A.
The term of office of each Police Commissioner shall
be for one official year, except for the first term. The first term of the
Chairman of the Board of Police Commissioners shall expire on April 5, 1982.
The first terms of the other two Commissioners shall expire on April 4, 1983,
and April 2, 1984, respectively.
B.
The annual compensation of the Chairman of the Board
of Police Commissioners shall be fixed by the Mayor and Board of Trustees.
The other two members of the Board of Police Commissioners shall serve without
compensation.

The Board of Police Commissioners is hereby authorized and empowered:
A.
To promulgate rules and regulations governing the operation
of the Police Department of the village.
B.
Notwithstanding the provisions of § 8-804 of
the Village Law, to supervise, control and direct the conduct of the members
of the Police Department of the village and all matters relative to the operation
of such Department, including the appointment, promotion, change in status
and removal of said members.

C.
To prepare, from time to time and as requested by the
Board of Trustees, fiscal reports relative to the operation of the Police
Department.
D.
To recommend to the Mayor and the Board of Trustees such
changes in the methods, practices and procedures involved in the operation
of the Department and in the procurement of equipment necessary or desirable
to promote modernization of the Department.
E.
To promote cooperation between the Police Department
of the village and that of the County of Nassau, looking to better and greater
utilization of county-provided services and methods so as to eliminate any
unnecessary and duplicative services provided by the village.
F.
To remain abreast of modern-day developments in the area
of law enforcement in the United States.
G.
To investigate and seek out federal and state funds which
may be used by the village to improve police procedures and operations within
the village.
H.
To do all things necessary and desirable to detect crime,
protect the inhabitants and property within the village, preserve the peace
and good order, suppress vice, protect and preserve public works and the general
safety, health, comfort and welfare of the inhabitants of the village, ensure
the maintenance of police protection at the highest standard of excellence
throughout the village and maintain economies and efficiency in the Police
Department.
I.
The Mayor shall delegate to the Board of Police Commissioners
and the Chairman thereof such other powers of the Mayor as set forth in § 4-4000,
Subdivision lb and e of the Village Law and such other powers as may be deemed
necessary or desirable to enable the Board of Police Commissioners and Chairman
thereof to effectively discharge the duties above set forth; provided, however,
that any such delegation of powers shall not in any way relieve or absolve
the Mayor from the responsibility to supervise the proper discharge by the
Board of Police Commissioners and the Chairman thereof of all of the obligations
placed upon the Mayor by the Village Law.

A.
The Chairman of the Board of Police Commissioners shall
be responsible for the day-to-day operations of the Police Department, to
include, but not be limited to, planning and organizing the activities of
the Department, scheduling and assigning work and supervising the work of
the sworn police officers and civilian staff.
B.
Wherever in the local laws, ordinances, resolutions,
rules or regulations of the village and the Police Department reference is
made to the Chief of Police, the title of Chairman of the Board of Police
Commissioners shall be substituted.
