Where this chapter imposes greater restrictions
than required by any other law, ordinance, or regulation, the provisions
of this chapter shall govern. Where the provisions of any other law,
ordinance, or regulation impose greater restrictions than are required
by this chapter, the provisions of such law, ordinance or regulation
shall govern.
If any part of this chapter is declared to be
invalid by any court of competent jurisdiction, such decision shall
not affect or impair the validity of said chapter as a whole, or any
other part of said chapter. The Town Board hereby declares that it
would have adopted this chapter and each part thereof irrespective
of the fact that any one or more of the parts may be declared invalid.
This chapter is intended to supersede, repeal
and annul the Regulations for the Subdivision of Land, formerly Chapter
A113 of the Code of the Town of Hyde Park.
An application for subdivision approval shall be exempt from the requirements of this chapter and Chapter
108, and subject to the 1979 Zoning Ordinance, as amended, and former Chapter A113, if, as of the effective date of this chapter, the Planning Board has approved a resolution granting preliminary subdivision approval for major subdivision and sketch plan approval for minor subdivision and said approval has not expired. To the extent that this section is inconsistent with Town Law § 274-a, 274-b, 276, 277, 278 or any other provision of Article 16 of the Town Law, the provisions of this chapter are expressly intended to and do hereby supersede any such inconsistent provisions under the authority of § 10 of the Municipal Home Rule Law.
This chapter shall become effective upon filing
with the Secretary of State.
