It shall be hereinafter declared unlawful for any person to park or stand any motor vehicle in any designated and posted fire zone in the Town of Hyde Park at any time of the day or night.
For the purposes of this article, the following definitions shall apply:
FIRE ZONE
Any area in all shopping areas, shopping plazas and shopping centers designated by a yellow painted stripe marking and posted with a conspicuous sign so designating the zone.
MOTOR VEHICLES
Any car, bus, truck, van and motorcycle or any other vehicle propelled by power or otherwise.
PARK or STAND
The stopping of any motor vehicle for any period of time, including the discharge of passengers.
A. 
It shall be the responsibility of the Building and Zoning Administrator to designate the various fire zones, and it shall be the responsibility of the owners of the property to paint the yellow stripe marking and post the necessary sign and to maintain same so that they may at all times be seen.
B. 
The Highway Superintendent shall provide, at the owner's expense, the necessary signs.
C. 
In the event the property owner does not provide the yellow stripe marking, post the necessary signs or maintain same after due written notification from the Building and Zoning Administrator of the Town of Hyde Park, the Town may enter upon said premises for the purpose of bringing about compliance with this article, and the cost of same shall become a charge against said property and property owner and a lien thereupon.

A. 
Any person found guilty of violating any of the provisions of this article shall be subject to and pay a penalty of $50 and/or be sentenced to up to five days in jail. For the purposes of this article, the owner of any unattended motor vehicle shall be presumed to have operated said motor vehicle; however, the same is rebuttable.
B. 
Any person who has been issued three summonses pursuant to this chapter in the preceding 18 months and has not satisfied the same with the Town of Hyde Park will be certified as a scofflaw. The Town of Hyde Park will notify the New York State Department of Motor Vehicles pursuant to the New York State Vehicle and Traffic Law, Article 14, § 401(5-a) and Article 20, § 514(4)(a).
