A.Â
A "handicapped person" shall mean any person who has
one or more of the following impairments, disabilities or conditions
which are permanent in nature:
(1)Â
Limited or no use at one or both lower limbs.
(2)Â
Neuromuscular dysfunction which severely limits mobility.
(3)Â
A pulmonary cardiovascular condition which limits
mobility or severely limits the individual's activities in the open
air.
(4)Â
A person whose physical or mental impairment or condition
is other than those specified above, but is of such a nature as to
impose unusual hardship and the utilization of public transportation,
facilities and such condition as certified by a physician duly licensed
to practice medicine in this state as a condition in equal degree
of disabilities specifying the particular condition so as to prevent
such person from getting around without great difficulty.
(5)Â
A child with any one or more of the impairments or
conditions listed above.
(6)Â
Any conditions for which a handicapped sticker has
been issued by any lawful authority.
B.Â
Authority and regulation for handicapped parking.
Pursuant to the authority granted, New York State Vehicle and Traffic
Law § 1660-a, and the authority granted in the Town of Hyde
Park by the Municipal Home Rule Law, the Town Board of the Town of
Hyde Park does hereby provide for the following with regard to handicapped
persons:
(1)Â
Each building servicing the public in the Town of
Hyde Park must provide a sufficient number of parking spaces for the
handicapped as set forth in New York State Uniform Fire Prevention
and Building Code Section 1102.4(a) and (b). Such buildings servicing
the public shall include, but not be limited to, shopping centers,
malls, plazas, multiple dwellings, retail stores, public buildings
and restaurants.
(2)Â
No person shall park a vehicle in a parking space
designated for parking for handicapped persons and identified by an
official traffic control device without displaying a valid official
parking permit for handicapped persons or an official license plate
for handicapped persons of any state.
Any person parking or allowing to stand any motor vehicle, bus, truck, trailer or any ether obstruction occupied or unoccupied in violation of § 104-18 hereof shall be guilty of a violation of this article and shall be subject to a fine of $50 for the violation hereof.
Any person who has been issued three summonses
pursuant to this article in the preceding 18 months and has not satisfied
the same with the Town of Hyde Park will be certified as a scofflaw.
The Town of Hyde Park will notify the New York State Department of
Motor Vehicles pursuant to the New York State Vehicle and Traffic
Law, Article 14, § 401(5-a) and Article 20, § 514(4)(a).
