It is the intent of this chapter to authorize the enforcement personnel of the office of the Code Enforcement Official and employees of the Town of Milton assigned to enforcement of ordinances and local laws to issue appearance tickets to persons and businesses in violation of ordinances and local laws enacted by the Town Board of the Town of Milton pursuant to the laws of the State of New York over which the office of the Code Enforcement Official is given enforcement jurisdiction pursuant to local laws and ordinances and any other person authorized by the Town Board of the Town of Milton and assigned to enforcement of local laws and ordinances. The Town Board of Milton enacts this chapter for the purpose of providing for efficient enforcement of building codes and all other codes enacted by the Town of Milton and ordinances, local laws, rules and regulations, including but not limited to fire protection, removal or repair of unsafe buildings or collapsed structures, drainage- and watercourses, freshwater wetlands, garbage removal, landfill, littering and posting, sewers and trees, shrubbery and other laws and ordinances and local laws of the Town of Milton.
The code enforcement personnel of the Code Enforcement Official's office and all other persons authorized by the Town Board of the Town of Milton to enforce local laws and ordinances shall have the power to issue an appearance ticket as the same is defined in Article 150 of the Criminal Procedure Law.
The power and jurisdiction of the persons authorized to issue appearance tickets pursuant to this chapter are limited to ordinances, codes and local laws enacted by the Town of Milton.
This chapter does not include the power to issue appearance tickets for a violation of the Penal Law of the State of New York.
