It shall be unlawful for any person under the age of 18 years, hereinafter referred to as a "minor," to be, loiter, idle, wander, stroll or play upon the public streets, highways, roads, alleys, parks, playgrounds or other public grounds, public places and public buildings, places of amusements and entertainment, vacant lots or other unsupervised places in the Borough, between the hours of 11:00 p.m. and 5:00 a.m., prevailing time.
Section 83-1 shall not apply if the minor:
A. 
Is accompanied by his or her parent or legal guardian;
B. 
Is upon an emergency errand or legitimate business directed by his or her parent or legal guardian; or
C. 
Is legally employed at a time that makes it necessary for him or her to be in or on the above public places. Proof of such employment and work hours shall be by a written document signed by the parent, legal guardian or employer.
It shall be the responsibility of the parents or legal guardian having the care and custody of a minor to comply with § 83-1 of this chapter.
Any minor violating any of the provisions of § 83-1 shall be taken into custody by the Borough police and delivered to his or her parent or legal guardian if such minor is a resident of the Borough. Otherwise, the police shall attempt to contact the parents or legal guardian by telephone and request them to pick up the minor in the Borough for the purpose of transporting the minor to his or her place of residence. In the event a parent or legal guardian cannot be contacted by the Borough police or does not pick up the minor, the minor shall be released with instructions to go immediately to his or her place of residence.
The Borough Police shall make a report of each incident and send one copy to the Juvenile Probation Department of York County, one copy to the Borough office and one copy to the parent or legal guardian.

For the first offense, a registered letter shall be sent to the parent or legal guardian informing them of the violation. For the second offense, the parent or legal guardian shall be guilty of a summary offense and, upon conviction thereof, be sentenced to pay a fine of not more than $600 or, failing to pay such fine, to imprisonment for a term not to exceed 30 days. Each violation of this provision is a separate offense.
