A municipal swimming pool shall be located in the Township parklands shown as Block 168, Lot 1, on the Township Tax Map.

a. 
Membership. The Township Committee shall appoint seven residents of the Township who are also members of the pool to develop policy and regulations concerning pool membership and all forms of recreation, playground and public entertainment activities carried on in connection therewith. The Township Committee shall also appoint two residents as alternate commission members to serve in the absence of any of the regular members. The Township Committee may appoint one of its own members as one of the Commission members or as an alternate Commission member. The Director of Recreation will serve as staff to the Pool Commission and will oversee the personnel and control the maintenance and day-to-day operations of the pool.
b. 
Terms of Office. Members of the commission, other than a member who is also a member of the Township Committee, shall be appointed for three year terms, except that the term for the two additional appointments authorized by this amendment shall, for their first term, be one year for one of such members and two years for the other of such members. Thereafter such members who are also members of the Township Committee, currently or at the time of appointment, the term of such member shall be for one year. Alternate members shall be appointed for one year terms. Whenever a vacancy shall occur other than by expiration of a term, the ensuing appointment shall be for the unexpired portion of the term only.
c. 
Officers. The pool commission shall meet as soon after January 1 of each year as practicable and elect a chairman, vice chairman, secretary and finance officer from among its regular membership. The first three officers shall have the duties normally associated with those positions. The finance officer will be assisted by the director of recreation in the administration of the approved annual budget and report biweekly during the season to the commission on the financial status of the pool.
d. 
Bylaws. The pool commission at its aforesaid organizational meeting shall adopt by-laws which govern the scheduling of its meetings, the necessary quorum for action, and any other appropriate organizational matters. The bylaws shall specify, however, that an advertised public hearing be held during the meeting at which the commission recommends the annual pool budget to the Township Committee.
e. 
Powers and Responsibilities. In furtherance of its general powers listed in paragraph a, the pool commission shall:

Determine policy on membership eligibility and maximum allowable membership.
2. 
Establish rules and regulations and membership code of conduct.
3. 
Assisted by the director of recreation, prepare, present and administer the approved annual budget, including seasonal fee schedule, guest fees, and capital improvements.
4. 
Develop hiring policy and criteria for job placement.
5. 
Assist the director of recreation in defining the job and the selection of a pool manager.
6. 
Plan membership social functions and assist the staff in their administration.
7. 
Communicate with the pool membership concerning pool operation.

The pool commission shall recommend the annual fee which shall be set by resolution of the Township Committee.

In addition to the regular payment plan, there is hereby instituted a reduced rate early payment plan. This will be included in the annual rate resolution provided by the Township Committee.

It is further established that there shall be a nonrefundable initiation fee for new members to be provided in the rate resolution adopted by the Township Committee.

There shall be various activity fees established from time to time by resolution of the Bernards Township Committee.
