Any person engaged or employed in the business or service of preparing, processing or serving food or drink intended for human consumption at a retail level shall apply to the Cedar Grove Health Department within seven days of the commencement of his said employment or engagement for a food handler's certificate and shall successfully complete all requirements for obtaining said certificate, including attendance at the next regularly scheduled food handler's training course given by the Township's Health Department or a state or county health agency, as required by § 142-11 herein.
The food handler's certificate shall not be
issued or granted to any person unless the person seeking such food
handler's certificate shall have first completed a course of general
instruction in health education, sanitation, personal hygiene, food
protection, dishwashing procedures and other related health matters.

Application for the food handler's certificate
shall include a fee of $2 payable to the Township of Cedar Grove.
Moneys shall be held in trust to reimburse Essex County.
No person to whom a food handler's certificate
is issued or granted shall give, loan, transfer or permit the same
to be used by any other person, for any purpose whatsoever.
All employers engaged in the business or service
of preparing and processing food intended for human consumption shall
at all times keep and maintain accurate records of the name and address
of each employee, date of employment and the date of issuance and
certificate number of said food handler's certificate, which records
shall be available at all times for inspection by the Health Officer
or his duly authorized representatives.
No employer shall continue to employ any person in connection with the preparation, processing or service of food or drink intended for human consumption at retail unless the person so employed shall have applied for and obtained a food handler's certificate within the periods specified in § 142-10 herein.
All owners or managers or supervisors shall
renew their food handler's certificates annually.
A food handler's certificate may be granted
to persons taking a comparable course of instruction in another municipality
approved by the Health Department, Township of Cedar Grove.
This article requiring a food handler's certificate
shall not apply to persons engaging in food handler's activities on
behalf of nonprofit institutions, churches or other charitable organizations
unless the said food handling activities are conducted on a regular
recurring basis. All governmental agencies and institutions except
local school districts, shall be exempt from the provisions of this
article.

A.
Any person who violates any provision of this article
shall, upon conviction thereof, be punished by a fine not exceeding
$1,000 or by imprisonment for a term not exceeding 90 days, or both.
A separate offense shall be deemed committed on each day during or
on which a violation occurs or continues.
B.
In addition, a certificate issued pursuant to this
article may be revoked or suspended when any certificate holder, who
is the owner of the property for which the food handlers' certificate
is issued, has failed to pay the taxes due on the property for at
least three consecutive quarters.
