§ 184-1 Title.

This chapter shall be known and may be cited as the "Parade Ordinance of the Township of Cedar Grove."

§ 184-2 Activities not regulated.

Nothing in this chapter shall apply or be construed to apply to:

A. Funeral processions.

B. Students going to and from classes or participating in educational activities, provided that such conduct is under the immediate direction and supervision of the proper school authorities.

C. A governmental agency acting within the scope of its functions.

§ 184-3 Definitions.

As used in this chapter, the following terms shall have the meanings indicated:

PARADE

Any parade, march, pageant, procession of any kind or any similar display in or upon any street, park or other public place in the Township.

PARADE PERMIT

A permit as required by this chapter.

§ 184-4 Permit required.

No person shall engage in, participate in, aid, form or start any parade unless a parade permit shall have first been issued by the Township Clerk after approval thereof in accordance with the provisions of this chapter.

§ 184-5 Application for permit; fee; waiver of fee.

A. A person seeking issuance of a parade permit shall file a written application with the Chief of Police on forms furnished by such officer.

B. The fee for a parade permit shall be $10, which fee shall be paid at the time of filing the application. Upon the showing of good cause, the Council may waive the payment of the permit fee.

§ 184-6 Time for filing application; consideration of late application.

A. An application for a parade permit shall be filed with the Chief of Police not less than 10 days nor more than 20 days before the date on which it is proposed to conduct the parade

B. Upon good cause shown, the Chief of Police may consider any application for a parade permit filed less than 10 days before the date such parade is proposed to be conducted.

§ 184-7 Criteria for permit approval.

The Chief of Police shall approve the issuance by the Township Clerk of a parade permit when, from consideration of the application and from such other information as may otherwise be obtained, he finds that:

A. The conduct of the parade:

(1) Will not substantially interrupt the safe and orderly movement of other traffic contiguous to its route.

(2) Will not require diversion of Township employees so as to prevent the furnishing of essential police, fire and health services in the Township.

(3) Is not reasonably likely to cause injury to persons or property, provoke disorderly conduct or create a disturbance.

B. The parade is not to be held for the sole purpose of advertising any commercial products, goods or events and is not designed to be held purely for private profit.

§ 184-8 Time limit for approval or denial of permit by the Chief of Police.

Within five days after the filing of an application for a parade permit, the Chief of Police shall act upon the application by approving or denying the issuance of a permit. Upon approval of the application, the Township Clerk shall issue the permit. If the application is not approved, the Chief of Police shall forthwith notify the applicant and provide him with the reasons for denial.

§ 184-9 Alternate permit; notice of acceptance by applicant.

A. In denying an application for a parade permit, the Chief of Police is empowered and authorized to approve the issuance, by the Township Clerk, of a permit, hereinafter referred to as the "alternate permit," for the conduct of the parade on a date, at a time or over a route different from that named by the applicant. If the applicant files, within three days after the notice of such action, a written notice of acceptance of such proposed alternate permit, the Township Clerk shall issue the permit.

B. Such alternate parade permit shall conform to all the requirements of and have the same effect as and be deemed to be a parade permit issued pursuant to this chapter.

§ 184-10 Appeals.

Any person aggrieved by the denial by the Chief of Police of a parade permit shall have the right to appeal such action to the Council within five days after notice of the denial. The Council shall act on the appeal within five days after receipt of the notice of appeal. If the Council approves the issuance of the parade permit, the Township Clerk shall issue the permit.

§ 184-11 Information to be included on permit.

Each permit issued under this chapter shall state the following information:

A. Starting and finishing time.

B. The portions of the streets to be traversed and occupied by the parade.

C. Such other information as the Chief of Police shall find necessary to the enforcement of this chapter.

§ 184-12 Responsibility of permittee.

The holder of a permit under this chapter shall comply with all permit directions and conditions and with all applicable laws and ordinances.

§ 184-13 Possession of permit required during the parade.

The parade chairman or other person heading or leading the parade shall carry the parade permit upon his person during the conduct of the parade.

§ 184-14 Violations and penalties.

Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine not exceeding $2,000 or by imprisonment for a term not exceeding 90 days, or both.
