Whenever an individual owner or a developer or a group of owners desire to open or improve a street which is heretofore or hereafter to be dedicated to public use and which would not come under Chapter 234, Subdivision of Land, they shall first obtain a permit from the Township Council.
Before any such street opening or improvement is begun, the owner, developer or person desiring to make such opening or improvement shall make an application for a permit in writing to the Council. The application shall contain or have attached thereto the following:
A. 
A map or survey showing the exact location of the street to be opened or improved and its relation to the nearest accepted existing and proposed street.
B. 
Three copies of a profile map and specifications showing the grade of the street and the location therein of all other public improvements determined to be necessary by the Township Council in accordance with Chapter 201, Public Improvement Specifications, and the official Township specifications. The Township Council, in requiring the installation of improvements, may utilize the requirements set forth under Chapter 234, Subdivision of Land, where deemed appropriate. Wherever required, proof shall be submitted of the legal right to dispose of drainage in the manner and at the place or places proposed.
C. 
A performance guaranty equal to that called for under Chapter 234 Subdivision of Land, shall be posted with the Township in an amount not less than the estimated cost of the improvements as determined by the Township Engineer, and a contract shall be written with the owner or owners setting forth their obligations and giving the Township the right to call upon the cash deposit to complete any unfinished work after a stipulated date of completion.

Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $2,000 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
