This chapter shall not be deemed to apply to or include swimming or wading pools established or maintained upon any premises by any individual for his own or his family's use or for the use of guests of his household.

A. 
As used in this chapter, the following terms shall have the meanings indicated:
SWIMMING POOL CODE OF NEW JERSEY (1970)
That certain code approved by the State Department of Health for adoption by reference by local boards of health in accordance with law, being a code:
(1) 
Regulating and controlling the location and construction, alteration and operation of swimming pools as therein defined.
(2) 
Regulating and controlling the issuance of licenses to locate and construct, alter or operate swimming pools as therein defined.
(3) 
Declaring and defining certain swimming pools as nuisances.
B. 
Whenever the following words, terms or phrases are used in the Swimming Pool Code of New Jersey (1970), they shall have the following meanings herein given:
BOARD OF HEALTH
The Department of Health of the Township.
REGISTERED MAIL
Includes certified mail.

A. 
Pursuant to and in accordance with the Public Health and Sanitation Codes Adoption by Reference Act (N.J.S.A. 26:3-69.1 to 26:3-69.6), there is hereby established and adopted as the Swimming Pool Code of the Township the whole of the Swimming Pool Code of New Jersey (1970). A printed copy of said code is annexed to and incorporated by reference in this chapter.
B. 
The Swimming Pool Code of New Jersey (1970) is hereby incorporated in this chapter by reference and made a part hereof as fully as though it had been set forth at length herein.
C. 
In accordance with law, 10 printed copies of the Swimming Pool Code of New Jersey (1970) have been placed on file in the office of the Township Clerk and in the office of the Health Officer of the Township and shall remain on file in said offices for the use and examination of the public so long as this chapter shall remain in effect.

No person shall operate a swimming pool until the licenses or permits therefor as required by the Swimming Pool Code of New Jersey (1970) shall have been issued by the Department of Health.

The fee for a license or renewal of a license under this chapter shall be $250 per annum; except that swimming pools maintained exclusively as accessory uses for training or testing functions in conjunction with a related commercial business shall pay a fee of $50 per annum.
Licenses issued under this chapter shall expire on April 15 of each year.
An application for renewal of a license issued under this chapter shall be submitted, together with the required fee, at least 10 days prior to April 15 of each year.
A. 
A license required under this chapter may be denied or suspended or revoked by the Township Health Officer, as head of the Department of Health, for failure to comply with any provision of this chapter, including the Swimming Pool Code of New Jersey (1970) incorporated herein by reference.

B. 
The person whose license has been denied or suspended or revoked may take an appeal as provided in § 31-7 of the Code of the Township of Cedar Grove.

Any person who violates any provision of this chapter, including the Swimming Pool Code of New Jersey (1970), shall, upon conviction thereof, be punished by a fine not exceeding $2,000 or by imprisonment for a term not exceeding 90 days, or both. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
