A Board of Health is hereby established in accordance with the provisions of an Act of the Legislature of New Jersey entitled "An Act To Establish in This State Boards of Health and a Bureau of Vital Statistics and To Define Their Respective Powers and Duties," approved March 31, 1887, and the several supplements thereto.[1]

The Board of Health shall consist of seven members, who shall be residents and legal voters of the borough. The members of the Board shall be nominated by the Mayor and appointed by him with the advice and consent of the Council. The terms of office of the members shall be three years.
If any vacancies occur in the membership of the Board, the vacancies shall be filled for the unexpired terms only by nomination and appointment as provided in § 40-2.
The Board of Health shall adopt rules and regulations for its government and shall elect a President from among its own members.
The Board of Health shall appoint a Registrar of Vital Statistics, Clerk and Sanitary Inspector and may also appoint such other officers or assistants as the Board of Health may deem necessary. All appointees of the Board of Health shall be governed by the rules of the Board, and they may be removed for cause by the Board.

A. 
License fees and other money collected or received, including all fees generated by the food handler's certification course under the Food Handler's Certification Ordinance shall be placed in a special account separate from any of the other accounts of the municipality and shall be used for the following purposes only:
(1) 
Audio/visual equipment to be used in connection with certification course;
(2) 
Tapes and other materials in connection with course;
(3) 
Compensation of instructors;
(4) 
Miscellaneous expenses in connection with certification course.
B. 
Any balance remaining in such account shall be retained until the end of the third fiscal year following and may be used for any of the purposes set forth in this section. At the end of said third fiscal year, any balance shall be transferred from such special account to the general funds of the municipality.
