[HISTORY: Adopted by the Mayor and Council of the Borough of Palisades Park 7-8-1976 as Sections 2-7.6 through 2-7.10 of the Revised General Ordinances of 1975. Amendments noted where applicable.]

As used in this chapter, the following terms shall have the meanings indicated:
BOARD
The Board of Health of the borough.
GARBAGE
The accumulation of animal or vegetable matter, or both, liquid or otherwise, that tends to decay, including solid waste material.
HEALTH OFFICER
The duly appointed executive officer or duly appointed Health Officer.
NUISANCE
Any condition which is dangerous to human life or health or that which renders air, water, soil or any type of food hazardous or injurious to human life or health, and as otherwise herein defined.[1]

The following specific acts or omissions, or the maintenance or allowance of any of the following conditions, are hereby prohibited and are declared to be or to constitute nuisances:
A. 
Depositing or maintaining any foul, decaying or offensive matter in or upon any lot, yard, street, house, building or other premises or public place.
B. 
Maintaining any excavation or any cans, barrels or other receptacles where water stagnates or mosquito larvas breed.
C. 
Allowing to exist any unclean or insanitary conditions in any cellar, room or building or any imperfect plumbing or sewer appliances or connections from which any foul or noxious odors or liquids may escape.
D. 
Permitting a growth of or failing to remove brush or weeds, including ragweed, the pollen of which is capable of being transported by act of nature through the air in such manner as to become injurious to health.
E. 
Permitting the emission of dense smoke, dust, gases or cinders in sufficient quantities to cause injury to health.
F. 
Maintaining or causing the maintenance or existence of any offensive matter, foul or noxious odors or gases or vapors and all causes of disease, which are injurious to the health of the inhabitants of the borough.
G. 
Maintaining a property in such a manner so as to cause the breeding of rats, mice or other rodents.

A. 
The owner or other person in charge and in control of any premises shall provide proper and suitable containers or receptacles for the removal of garbage and other refuse material. All garbage and other refuse material shall be placed in containers on the sidewalk for collection at a time no earlier than 9:00 p.m. of the day prior to the day scheduled for the collection.

B. 
All containers used for such collection must be removed from the sidewalk no later than 12:00 midnight of the same day of the collection.
C. 
The owner or other person in charge and in control of any premises which abuts Broad Avenue in the Borough of Palisades Park shall provide proper and suitable containers or receptacles for the removal of garbage and other refuse material and place said containers on the sidewalk for collection at a time no earlier than 6:00 a.m. but no later than 10:00 a.m. of the day scheduled for the collection.

The fact that any of the conditions exist on any occupants' premises in the borough in violation of this chapter shall be prima facie evidence that the occupants of such premises are responsible for the violation.
The Police Department and all members thereof and the Superintendent of Public Works and the Health Officer shall have the right to issue summonses to all persons violating this chapter.
