[HISTORY: Adopted by the Mayor and Council
of the Borough of Palisades Park 7-8-1976 as Chapter IX of the Revised General
Ordinances of 1975. Amendments noted where applicable.]
All swimming pools, tanks or plunges now or
hereafter constructed and maintained in the borough shall be equipped
with chlorinating equipment of acceptable capacity and design which
will provide in the water, at all times when the pools, tanks or plunges
are in use, a residual of excess chlorine of not less than 0.4 part
per million or more than 0.6 part per million or an excess residual
of chloramine of not less than 0.7 part per million or more than 1.0
part per million. No swimming pool, tank or plunge shall have, when
in use, a residual of excess chlorine or chloramine in the water above
the maximum or below the minimum above set forth.
The water in all swimming pools, tanks or plunges
shall be kept, at all times, in a sanitary and safe condition for
bathing purposes.[1]

Whenever any swimming pool, tank or plunge,
by reason of mechanical defect, water impurity or failure to comply
with the requirements of this article, is a hazard to the public health,
the Health Officer of the borough is hereby authorized to order such
pool, tank or plunge to be immediately closed until the same complies
with the requirements of this article and until no further hazard
to the public health exists.[1]

Whenever, in the judgment of the Building Inspector of the borough, it shall be deemed necessary in the interest of public safety to require a fence to surround any swimming pool, tank or plunge now in existence or hereinafter constructed, the Building Inspector shall notify the owner or operator to erect such a fence. The fence shall be erected of sound materials commonly used for fencing, such as but not limited to chain link, wood picket, stockade, woven wire, woven wood or snow fencing, erected in accordance with standard construction practices. No fence shall be less than four feet in height. Any fence to be erected in excess of four feet in height shall be governed by an ordinance entitled "An Ordinance Controlling and Regulating the Erection of Fences in the Borough of Palisades Park, County of Bergen, State of New Jersey," contained in Chapter 135, Fences, of the Code of the Borough of Palisades Park.[1]

There are hereby created and established rules
and regulations for the use and operation of the borough swimming
pool facilities. Use of the swimming facilities shall be subject to
such rules and regulations as may be promulgated by the Mayor and
Council by ordinance or resolution, which shall be posted at all times
upon the bulletin board at the swimming facilities, and a copy thereof
shall be filed with the Borough Clerk for public inspection.
As used in this article, the following terms
shall have the meanings indicated:
Each individual's age on September 15 of each year.
The total park area.
The area of concrete immediately surrounding the pool.
The entire fenced area surrounding the pools and the bathhouse.
The area of the park designated for food consumption.
Persons attending high school or college on a full-time basis.

A.
Types of memberships:
(1)
A family membership shall include the husband, wife
and unmarried children under age 21 or full-time students residing
within the same household.
(2)
A married couple membership shall include the husband,
wife and children under age two.
(3)
An individual membership shall be available to a permanent
resident of the borough not a member of a family membership over the
age of 15.

(4)
A head of household membership shall mean a widow,
widower or divorced parent and one child.
(5)
A senior citizen membership shall be available to
permanent residents 62 years of age or older.
(6)
A special membership may be granted under unusual
circumstances upon the recommendation of the Swimming Pool Commission.
(7)
Nonresident memberships. If the pool membership does
not reach the quota for good budgetary financing, a member of good
standing may sponsor one nonresident family. Applications for this
purpose will be available at the Municipal Building.
B.
All memberships are granted subject to the rules and
regulations as established by the Mayor and Council by ordinance or
resolution. Failure to abide by these rules and regulations may result
in revocation or suspension of membership.

Guest passes shall be valid for two years from
the date of purchase.

A.
Prior to the closing of the Palisades Park schools,
the hours of operation will be determined by the Pool Manager.
B.
After the closing of the Palisades Park schools and
through Labor Day, the hours of operation for general swimming will
be as follows:

The above hours of operation may be changed without
notice if, in the reasonable judgment of the Pool Manager or Assistant
Manager, it appears necessary or desirable to close the pools.

(1)
The procedure for pool closing resulting from the
threat of lightning shall be as follows:
(a)
As soon as the Manager, Assistant Manager or
employee in charge of the municipal pool hears threatening thunder
or sees lightning, he shall immediately evacuate the pool area.
(b)
An announcement must be made by the Manager
or Assistant Manager informing the guests and the members of the thunder
or lightning in the area and advising all guests and members that
they have the option to go under the pavilion or exit the complex.
(c)
The chief pool officer on duty shall immediately
call the nearest weather bureau to determine the forecast.
(d)
The pool officer in charge of the pool shall
wait 45 minutes after the last threatening thunder or sighted lightning
and thereafter reopen the pool. If threatening thunder or sighted
lightning occurs after the pool is reopened, the provisions as set
forth above will be repeated.
(e)
The Manager or Assistant Manager will once again
wait another 45 minutes after the last thunder or lightning and again
will reopen the pool.
(f)
If threatened thunder or sighted lightning occurs
after the pool is opened a second time, then another phone call will
be made to the weather bureau. If such call to the weather bureau
indicates that this threat of lightning will continue, then the supervising
pool official may close the pool for the remainder of the day.
(2)
Procedure for cloudy or overcast day. On a cloudy or overcast day the pool will remain open and the Manager or Assistant Manager shall remain on the premises until either rain, threatening thunder or sighted lightning occurs, in which event, the Manager or Assistant Manager will follow the procedures as set forth in Subsection C(1).
(3)
The snack bar shall remain open at all times the pool
is open, including the interim periods of temporary closing during
threatening thunder or sighted lightning.
A.
All members will be issued identification badges,
which must be shown for admission to the area.
B.
Identification badges will not be transferable.
C.
Illegal transfer of badges, the giving of false information
or the defacing of identification badges will result in revocation
or suspension of membership.
D.
A lost identification badge shall be reported to the
Pool Manager immediately and can be replaced by a new identification
badge, which will be issued upon payment of a fee of $5.

A.
All bathers, including babies, shall wear bathing
suits (cut-down Levi's, pants, etc., not included) in the swimming
and wading pools.
C.
All persons using the pool shall shower prior to entering
the pool, using soap and water.
D.
Any persons having a communicable disease, open blisters
or cuts, sore or inflamed eyes, ears, nose or mouth infections, excessive
sunburn or any type of skin disease will be excluded from the pool
apron area. No person having any type of bandage, cast or Band-Aid
shall be permitted in the pool.
E.
No inflatable water paraphernalia shall be allowed
within the main and training pool areas. Swim masks shall be permitted
on a special permit.
F.
Diving will be permitted in designated areas only.
G.
No one will be allowed in the water unless a lifeguard
is present
H.
No swimming will be permitted in diving areas.
I.
Children up to and including six years of age shall
be accompanied to the wading pool area by a responsible person, who
shall remain in the wading pool area.
J.
Various types of swimming instruction will be made
available to members.
A.
All vehicles shall be parked in designated areas.
B.
Street clothing shall be left in designated areas.
C.
No person shall comb his hair within the pool apron
area. Curlers shall not be worn within the pool apron area.
D.
All food and drink must be consumed within the snack
bar area only. No eating or drinking is allowed in the playground
area. Each member or guest must deposit refuse in proper receptacles
and must clean up the area used.

E.
Children under 12 years of age will not be admitted
to the pool area unless accompanied by a responsible person over the
age of 18. The responsible person must stay with the child at all
times.

F.
Willful destruction of property will result in suspension
or revocation of membership.
G.
The pool management will not be responsible for valuables
brought into the area.
H.
All litter, paper or debris shall be placed in designated
trash receptacles. Violators will be subject to ejection from the
pool.
I.
Dress in and out of the pool will be consistent with
standards of good taste.
J.
Street shoes will not be permitted within the pool
apron area.
A.
No glass or metal containers will be permitted within
the pool area.
B.
No alcoholic beverages will be permitted in the park
or pool area.
C.
No bikes, baby carriages or strollers will be permitted
unless parked in designated areas.
D.
No wrestling, running, ballplaying or other similar
activity will be allowed within the pool apron and parking areas.
E.
No pets or animals will be allowed in the park area.
F.
No honking of horns or loitering will be permitted
in the parking area.
G.
No smoking will be permitted at the pool apron.
H.
No spitting, expectoration, spouting of water or other
similar action will be allowed in the pool area.
I.
No roughness, rowdiness, profanity or other conduct
affecting the safety and comfort of others will be permitted.
A.
Regulations shall be posted at the pool and strictly
enforced.
B.
The Pool Manager or the Assistant Manager may close
or limit the swimming facilities whenever, in his judgment, such action
is deemed necessary or desirable for the protection of the health
or safety of such persons entitled to use such facilities.
C.
Members of the Police Department of the borough, the
Pool Manager and the Assistant Manager and all lifeguards, when on
duty at the swimming facilities, shall have the authority to prohibit
any action or conduct which they may consider to be dangerous, improper,
or immoral or any act or actions in violation of the rules and regulations
hereinbefore provided and shall have the power of expulsion or suspension
of privileges granted to the holder of a membership card.

Chapter 9 of the State Sanitary Code, Public
Recreational Bathing (N.J.A.C. 8:26), is hereby incorporated into
this chapter and becomes a part thereof.[1]
A.
Any person violating any of the provisions of this
article may have his membership suspended by any of the aforesaid
enforcement authorities.
C.
Nothing in this article shall limit the right of law
enforcement officers to make summary arrests for violations of any
other municipal ordinances or state statutes which would result in
hearings before the Local Judge.
