A.
The following specific acts or omissions, or the maintenance
or allowance of any of the following conditions, are hereby declared
to be or to constitute nuisances and are prohibited:
(1)
Depositing upon, or using to fill up or raise, the
surface or level of any lot, grounds, dock, wharf, pier, street or
alley in this Borough, or any ground filled for the purpose of building
thereon, unless pursuant to a special permit from the Board, any animal
or vegetable substance; or garbage or street sweepings, muck or silt;
or dirt in cleaning yards, buildings, sewers, docks or slips; or wastes
of mills or factories; or any materials which are offensive to health
or tend to decay, to become putrid or to render the atmosphere impure
and unwholesome.
(2)
Maintaining any excavation or any cans, barrels or
other receptacles where water stagnates or mosquito larvas breed or
permitting any pool or pond of water to exist for more than seven
days.
(3)
Throwing or overflowing any water slops, stable drainage,
liquid filth or septic tank or privy contents upon any public or private
property.
(4)
Maintaining any polluted well, spring, stream or supply
of drinking water.
(5)
Taking or allowing any dog to enter any store where
food is offered for sale.
(6)
Maintaining any chimney, smokestack, pipe or flue
or any part thereof that is out of repair and so defective as to allow
coal gas or other noxious fumes to escape into the building where
it is situated or into any adjacent building.
(7)
Allowing to exist any unclean or unsanitary conditions
in any cellar, room or building, any imperfect plumbing or sewer appliances
or connections from which any foul or noxious odors or liquids may
escape.
(8)
Keeping cattle, poultry or small animals in any building
used as a human habitation, except for small animals or domestic birds,
commonly used as pets.
(9)
Maintaining any vehicle used for hire or for public
conveyance in a dirty or unsanitary condition.
(10)
Permitting a growth of or failing to remove brush
or weeds, the pollen of which is capable of being transported by act
of nature through the air in such manner as to become injurious to
health.
(11)
Permitting the emission of dense smoke, dust, gases
or cinders in sufficient quantities to cause injury to health.
(12)
Maintaining or causing the maintenance or existence
of any offensive matter, foul or noxious odors, gases or vapors and
all causes of disease, which are injurious to the health of the inhabitants
of the Borough.
(13)
Depositing, accumulating or maintaining, in or on
any land, premises, building or other place, any matter or thing which
serves as food for insects or rodents and to which they have access
or which serves or constitutes a breeding place or harborage for insects
or rodents.
(14)
All sunken lots or marshlands or lots below grade
where stagnant water gathers or is collected, and any owner or owners
or agent or tenant of any such lot or lots or lands shall, on written
notice from this Board, correct and abate this nuisance in the manner
prescribed by this Board in said notice.
(15)
Maintaining stationary lights in residential areas,
other than public streetlighting, of sufficient magnitude to cause
discomfort or injury to health.
(16)
Fogging or spraying for insect control using any solution
not meeting New Jersey Department of Agriculture standards or in such
a manner, whether by reason of wind or weather conditions or otherwise,
as to permeate the atmosphere of property, public or private, not
consenting thereto in advance.
(17)
Using or permitting to be used a building or any part
thereof as a place for the storage of any article or articles detrimental
to health.
(18)
Pollution, or the existence of a condition or conditions
which cause or threaten pollution, of any waters in this municipality
in such a manner as to cause or threaten injury to any inhabitants
of this municipality either in their health, comfort or property.
(19)
The escape into the open air from any stack, vent
or chimney or any entrance to the open air or from any fire into the
open air of such quantities of smoke, fly ash, dust, fumes, vapors,
mists or gases as to cause injury, detriment or annoyance to the inhabitants
of this municipality or endanger their comfort, repose, health or
safety.
(20)
The growth, existence or presence of poison ivy within
20 feet of any property line.
(21)
Maintaining a property in such a manner as to cause
the breeding of rats, mice or other rodents.
(22)
Any dead or dying tree or dead and dying parts thereof,
accumulations of ice or similar conditions which, by reason of their
location, constitute a safety hazard to persons or property.
Toxic, hazardous and/or explosive substances
must be disposed of in accordance with federal and State of New Jersey
regulations.

No commercial business, including landscaping
concern, generating noise which disturbs the peace may begin operating
before 7:00 a.m. or after 8:00 p.m. on any day.
All multiple-dwelling owners must submit a boiler
inspection report, done by a certified inspection agency, during August
and September of each year to the Board to ensure the proper operation
of said boiler during the heating season.
All lawns, hedges, bushes, weeds and growth
or vegetation of any kind shall be kept trimmed and shall not be permitted
to become overgrown.
