[HISTORY: Adopted by the Board of Trustees of the Village of Port Jefferson 9-14-1977 by L.L. No. 14-1977 (Ch. 4 of the 1970 Code). Amendments noted where applicable.]

Notwithstanding any provisions of the Uniform District Court Act and/or the Uniform Justice Court Act, the following officials, officers, employees and personnel of the Incorporated Village of Port Jefferson shall have the power to issue and serve, within the Village of Port Jefferson, appearance tickets and subpoenas in cases arising in connection with the performance of their duties. Such services shall have the same force and effect as if served by a peace officer without their being peace officers:
A. 
Chief Building Inspector, Senior Building Inspector, Building Inspector or his deputy and/or designee.

B. 
Port Jefferson Village Fire Marshal, or his deputy, and Town of Brookhaven Fire Marshal.

C. 
Highway Labor Crew Leader/Highway Superintendent.
D. 
Parking Violations Officer.
E. 
Appearance Ticket Officers.
F. 
Code Enforcement Officer.
G. 
Constables.
H. 
Ordinance Inspector.

Appearance tickets shall be issued in compliance with Article 150 of the Criminal Procedure Law of the State of New York.
A. 
An appearance ticket issued and served pursuant to this chapter for violation of any of the ordinances, codes or local laws of the Incorporated Village of Port Jefferson shall be returnable in the Village Justice Court on the date and time as set forth on the appearance ticket and shall be substantially in the following form.

Editor's Note: The appearance ticket originally appearing in this section was deleted by L.L. No. 4-1992. The ticket currently being used is on file in the office of the Village Clerk.
B. 
This summons shall be in duplicate, with the copy being served upon the defendant, the original sent to the Court along with the accusatory instrument.
