Emergency fire lanes; violations and penalties.
[Added 8-24-1978 by Ord. No. 1978-6]
(1)
No person shall park, allow to be parked or leave standing any vehicle within any emergency fire lane established pursuant to § 83-13 of the Code of the Township of Caln.[1] Any vehicle parked within such emergency fire lane at any time shall be removed by towing at the order and under the direction of the Township Fire Marshal or any uniformed police officer.
[1]
Editor's Note: Section 83-13 was contained in former Ch. 83, Fire Prevention, adopted 7-8-1975 by Ord. No. 1975-7, which was repealed 9-12-2002 by Ord. No. 2002-15.
(2)
Violations and penalties.
(a)
Any person violating this subsection shall be subject to a fine in the amount of $25; provided, however, that if paid within seven days of the date of the violation, the fine shall be reduced to $10. A notice of violation of the provisions of this subsection shall be placed on the vehicle parked in violation, such notice to contain instructions to the owner or operator of such vehicle that, if he or she shall pay the fine at the Township Treasurer's office or deposit in the box provided at the front door or mail the fine within the envelope provided, within the appropriate time limits set forth herein, the same shall save the violator from prosecution. For purposes of this section, the fine shall be considered paid if postmarked on or before the seventh day.
[Amended 4-13-1982 by Ord. No. 1982-6; 1-29-1987 by Ord. No. 1987-1]
(b)
For the purpose of levying this fine, both the operator and the owner of the vehicle shall be jointly and severally liable. However, this shall not be construed to impose liability upon a vehicle's owner where the vehicle has been reported as stolen or where the vehicle was being operated without the express or implied consent of the owner, until such time as the owner is given notice of the violation, either personally or by notice sent to the address at which the vehicle was registered.
