The ordinances of the Township of Springfield of a regulatory nature and ordinances of a general and permanent nature, as revised, consolidated, codified and rearranged into titles, chapters, sections and subsections and as set forth in Chapters 1 through 144 inclusive and an Appendix consisting of Parts I, II, III, IV and V of that certain Code entitled the "Code of the Township of Springfield," are adopted and enacted as the Code of the Township of Springfield.
This ordinance and the body of laws consolidated and codified hereby shall be known and may be cited as the "Code of the Township of Springfield."
All provisions of the Code of the Township of Springfield, sometimes herein referred to as the "Code" shall be in full force and effect on and after the effective date of this Act. All ordinances and parts of ordinances in force and in effect on the effective date of this Act, and inconsistent with any provision of the Code are repealed as of the effective date of this ordinance, except as follows:
A. 
Any existing resolution, ordinance or ordinances not contained in the Code of the Township of Springfield and not inconsistent with said Code or any provision thereof, shall remain in full force and effect.
B. 
The repeal of any ordinance shall not affect:
(1) 
Any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before the effective date of this ordinance.
(2) 
Any prosecution, action, suit or other proceedings pending, or any judgment rendered or fine imposed on or prior to the effective date of this ordinance.
(3) 
The appropriation or expenditure of money, or promise or guaranty of payment, or transfer of funds.
(4) 
The issuance and delivery of any bonds, obligations or other instruments or evidence of indebtedness.
(5) 
The levy or imposition of taxes, assessments or charges.
(6) 
The annexation or detachment of territory.
(7) 
Any ordinance authorizing local improvements.
(8) 
Any ordinance or resolution authorizing the Township of Springfield to enter into or assume a contract or contracts, or any contract of or obligation assumed by the township.
(9) 
Any provision of an ordinance or resolution of the governing body of the township creating employments, positions or offices and fixing duties, salaries and compensation therefor which are not provided for in the "Code of the Township of Springfield" and which are not in conflict or inconsistent therewith.
(10) 
Any public right, right-of-way or easement acquired, established, vacated, released or extinguished in any street, road, highway, park or other public place within the township or any portion thereof.
(11) 
Any ordinance of the township providing for: designating, laying out, establishing, opening, altering, widening, relocating, straightening, establishing grade, naming or changing name, improvement, acceptance, dedication or vacation of any street, road, highway, park or other public place within the township, or any portion thereof.
The chapter, article and section headings and notations of history of an ordinance which appear in bold face type in the Code are for information purposes only and are not to be deemed to be a part of provisions of the ordinance, of the Code or any amendment thereto unless expressly so provided.
The provisions appearing in this Code, so far as they are the same as those of the ordinances existing at the time of the adoption of this Code, shall be considered as a continuation thereof, and not as new enactments.
At least one certified copy of said Code shall be kept on file in the office of the township. It shall be the duty of the Township Secretary to insert in their designated places all amendments or ordinances which indicate the intention of the Township Commissioners to make the same a part of said Code, when the same have been printed or reprinted in page form, and to extract from said Code all provisions which may be from time to time repealed by the Township Commissioners. Said certified copy of copies of the Code shall be available for all persons desiring to examine the same and shall be considered the official Code of the Township of Springfield.
It shall be unlawful for any person, firm or corporation to change, or amend by additions or deletions, any part or portion of said certified copy of the Code, or to insert or delete pages or portions thereof, or to alter or tamper with said Code in any manner whatsoever which will cause the law of the Township of Springfield to be misrepresented thereby. Conviction of said offense before a Justice of the Peace shall be punishable by a fine of not less than $10 and not exceeding $100 and, in default of payment of said fine and costs, by imprisonment for a period of not more than 30 days. Such fine and imprisonment shall be in addition to any other penalty imposed by any other section of the Code and shall be in addition to any action which may be available to the township, its officials or employees, in law, equity or otherwise, for any damage or loss sustained by it, them or any of them or any improper action or decision made by reason of such misrepresentation, change, addition, alteration or deletion.
The provisions of this Code are severable, and if any of its provisions or exemptions shall be held illegal, invalid or unconstitutional, the decision of the Court shall not affect or impair any of the remaining provisions of this Code. It is hereby declared to be the legislative intent that this Code would have been adopted if such illegal, invalid or unconstitutional provisions or exemptions had not been included herein.
This ordinance shall take effect upon final passage and publication in accordance with law.

A. 
Specific penalties

(1) 
Whenever any of the provisions of the Code of the Township of Springfield, or any of its regulations pursuant thereto, shall be violated by any person, persons, firm or corporation, upon judgment against any persons by summary conviction or by proceedings by summons before any District Justice, said person, persons, firm or corporation shall pay a fine and penalty not exceeding $1,000 in any instance for any violation of the following specific chapters of the Code:

And further, a fine and penalty not exceeding $600 for any violation of the following specific chapters of the Code:

(3) 
In addition to the above fine and penalty, any individual or persons found guilty by proceedings before the District Justice shall also be responsible for costs of prosecution, and in default of payment of the fine or penalty imposed by said judgment and the costs, the defendant may be sentenced and committed to the county jail for a period not to exceed 30 days.
B. 
In addition to or in lieu of any other remedy herein contained or provided by law, and whenever such person shall have been notified by the Township Manager Secretary or other township authority or by service of a summons of prosecution or in any other way that he or she is committing such violation of the provision of the Code, each day or portion thereof that he or she shall continue such violation, after such notification, shall constitute a separate offense, punishable by a like fine or penalty; such fines or penalties shall be collected as like fines or penalties are now by law collected.
All sections of the Code of the Township of Springfield inconsistent with the penalty provisions herewith are hereby repealed, with the specific exception of Chapter 123, entitled "Subdivision and Land Development," Chapter 138, entitled "Vehicle and Traffic," and Chapter 143, entitled "Zoning."
