A. 
This ordinance shall be known and may be cited as the "Park Ordinance."
B. 
As used in this ordinance, the following terms shall have the meanings indicated:
PARK
Includes playgrounds and all areas under the jurisdiction of the Springfield Park and Recreation Board, whether or not said areas have been fully dedicated to park use or conditionally placed under the jurisdiction of said Park Board.
A. 
No person shall be allowed in a park except between sunrise and sunset, unless a permit has been obtained as hereinafter provided. An exception shall be made for these persons making use of the lighted areas expressly designated for the playing of tennis or basketball and who are actively engaged in the participation of said sports.

B. 
No persons shall enter or leave a park except by entrances or exits provided for such purpose.
C. 
No persons shall stand or lie on a table, bench or seat.
D. 
No persons shall enter a toilet set apart for the use of the opposite sex.
E. 
No intoxicated person shall be permitted in a park.
F. 
No distribution or consumption of beer, ale or other intoxicating beverages shall be allowed in any park.
G. 
No gambling or any obscene or indecent act or any abusive, threatening, indecent or profane language or any conduct that may annoy others shall be allowed in a park.
H. 
No person shall solicit alms or subscriptions in a park.
I. 
No horses, dogs (other than those on a leash) or other animals shall be permitted in a park.[1]

J. 
No person shall park any vehicle in any portion of a park except in spaces definitely set aside and marked for parking purposes, and no person shall occupy a parked vehicle after dark except with the interior light turned on.
K. 
No person shall commit the following actions within or on property owned and managed by the Township of Springfield as a park or playground within the Township of Springfield:

(1) 
Violate the prohibitions of Chapter 48, Firearms and Fireworks.
(2) 
Carry or possess any firearm in violation of the Pennsylvania Uniform Firearms Act Chapter 61.
(3) 
Carry or possess a bow, any other instrument designed to shoot any pointed arrows, or arrows pointed with stone, wooden or metal tips; or any air rifle, air gun, BB gun, spring gun, paintball gun or any implement or weapon which is designed to impel with force a projectile of any kind.
(4) 
Leave dead animals or offensive matter.
L. 
No person shall scatter, drop or leave any paper, rag, garbage, dead flowers and plants, glass, tin cans or other rubbish anywhere in a park, except in receptacles provided for such purpose.[2]

M. 
No person shall injure, damage or deface any buildings, structures, fences, bridges, playground equipment or other property in a park; or climb any tree; or break, cut down, trample upon, remove or in any manner injure or damage any ornament, rock, stone, tree, plant, shrub, fern, blossom, flower or turf, or foul or contaminate any stream or water. The picking of violets, buttercups, daisies or dandelions is permitted.
N. 
No person shall annoy, injure or kill any animals or birds in a park; or disturb any fish or waterfowl in the streams, pools or ponds; or remove or carry away any bird's nest or eggs.
O. 
No person shall injure, deface or destroy any public signs or notices posted in a park.
P. 
No advertisement, placard or notice, except notices of the Township or agencies thereof, shall be posted or distributed in a park.[3]

Q. 
No person shall light or permit a fire to burn in a park except in fireplaces provided for such purpose.
R. 
No meetings for political, industrial or other similar purposes shall be permitted in a park.
S. 
The playing of golf in any park is prohibited except on putting greens provided for such purposes.
T. 
The promiscuous use of javelins, arrows, discus or similar athletic equipment dangerous in character is prohibited unless used under the direct supervision of an authorized playground supervisor.
U. 
The use of a park for any of the following purposes is prohibited unless a permit is first obtained from the Township Secretary as hereinafter provided:
(1) 
Sale of merchandise.
(2) 
Use of fireworks.
(3) 
Musical or theatrical entertainments.
(4) 
Overnight camping.
(5) 
Parties or gatherings in excess of 25 persons for any purpose whatever.
(6) 
Use of the park between sunset and sunrise.

V. 
No person shall operate a motorized vehicle within a park in any area not expressly designated for motorized vehicles unless authorized by the Park and Recreation Board.

W. 
No person shall use a tennis court for any other purpose except the game of tennis.

X. 
No artificial lighting shall be permitted on or around the athletic playing fields of Crowell Park, including but not limited to football, baseball, tennis and basketball.

The Police Department shall enforce the regulations hereinabove set forth and shall exercise general supervision over persons and property in all parks.
The Springfield Park and Recreation Board shall have general custody of all parks, subject to such conditions of jurisdiction herebefore or hereafter imposed by resolution or ordinance, and all maintenance, repairs and replacements of property and equipment therein, and shall be chargeable with the duty of keeping the parks in a clean and sanitary condition at all times. In view of the fact that the parks and playgrounds of the Township have been acquired and are maintained primarily for the use of the residents of the Township, the Springfield Park and Recreation Board, or any person or persons designated by it, shall have the right to exclude therefrom any person who is not a resident of the Township.
Special permits for the use of parks shall be issued by the Township Secretary upon application therefor. No charge shall be made for such permits. No permit shall be issued, however, unless an application therefor is made to the Township Secretary in writing at least 24 hours before the applicant intends to use the same. Any person to whom a permit is issued shall be liable for any loss, damage or injury sustained by any person by reason of negligence or fault of the applicant, his servants, agents or employees.
Any person violating any of the provisions of this ordinance shall be liable to a penalty of not more than $100 for each and every offense, to be collectible before any Justice of the Peace of the Township, as like penalties are now by law collectible.
All ordinances or parts of ordinances inconsistent herewith are hereby repealed.

The provisions of this chapter are severable and if any section, sentence, clause, part, or provision hereof shall be held illegal, invalid, or unconstitutional by any court of competent jurisdiction, such decision of this shall not affect or impair the remaining sections, sentences, clauses, parts or provisions of this chapter. It is hereby declared to be the intent of the Board that this chapter would have been adopted if such illegal, invalid, or unconstitutional section, sentence, clause, part or provision had not been included herein.

This chapter shall become effective 30 days following final adoption by the Board of Commissioners and publication as required by law.
