It shall be unlawful for any parent or guardian to assist, aid, abet, allow, permit, suffer or encourage a minor to illegally register or enroll in the Township of Ewing school system where the minor is ineligible to attend as a result of the minor's nonresident status.
It shall be unlawful for any person to knowingly permit his or her name, address or other residence-designating documentation to be utilized in the registration or enrollment of any nonresident student in the Township of Ewing school system unless previous approval has been granted by the Superintendent of the Township of Ewing School System or his or her designee. Any person violating this section shall, upon conviction thereof, be assessed the resident tuition for the student prorated to the time of the student's ineligible attendance in the school district. Tuition shall be computed on a basis of 1/180 of the total annual per-pupil cost to Ewing Township School District multiplied by the number of days of ineligible attendance.
There shall be a presumption that a violation of this chapter occurred upon a finding by the Department of Education or other appropriate authority that the student at issue was illegally enrolled in the school system of the Township of Ewing utilizing the address of the resident, regardless of whether the finding names the resident who has unlawfully permitted his/her property's address to be used to facilitate the illegal enrollment or attendance by the student at issue.
Any person violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punished by a fine of not more than $2,000. The Court may also order restitution as set forth in § 290-2 above. Nonpayment of any penalty or restitution order imposed by the Municipal Court pursuant to this section shall result in the imposition of a municipal lien against the property utilized to facilitate the illegal enrollment or attendance by the student at issue.
Upon the effective date of this chapter, the Township Clerk's Office is hereby instructed to immediately forward a certified copy of this chapter to the Township of Ewing Police Chief and Municipal Judge.
