The Board of Trustees of the Village of Alexandria
Bay hereby finds that it is necessary to focus responsibility for
the maintenance and upkeep of sidewalks within the Village of Alexandria
Bay and to assign such responsibility. It is the purpose of this article
to establish that each property owner shall be responsible for the
maintenance and upkeep of the sidewalks immediately adjacent to their
property.
As used in this article, the following terms
shall have the meanings indicated:
Any partnership, corporation, association, firm, company,
society or group.
Any person owning or occupying property within
the Village of Alexandria Bay or any person having the charge or control
of any premises, lot or establishment within the Village of Alexandria
Bay shall be required to remove all snow, ice or other substances
that collect on the sidewalks fronting on or belonging to the premises
no later than 10:00 a.m. on the day after the same shall have fallen
or collected thereon or shall so remove within two hours after being
notified by the Mayor, Village Clerk or any enforcement officer of
the Village, including any police officer, to remove the same, so
that such public walks shall be unobstructed or unimpeded and safe
for public travel.
If at any time the Village is required to perform
snow or ice removal on any sidewalk due to the inability or refusal
of any person charged with the duty to so remove, to do so the Village
shall be allowed to charge such person for such removal at the regular
hourly rates then in effect for Village employees and equipment. Such
charges may be considered a special assessment on the property and
added to the next tax bill and shall otherwise be a lien on the property.
In no event is the Village of Alexandria Bay
to be considered responsible for the removal of snow or ice from any
sidewalk within the Village of Alexandria Bay. Such responsibility
shall be the sole responsibility of the person who owns or occupies
or has control of the premises adjacent to the sidewalk.
Any person not complying with the requirements
of this article shall be guilty of a violation and, upon conviction
thereof, shall be punishable by a fine not exceeding the sum of $250
or by imprisonment by a term not exceeding 15 days, or by both such
fine and imprisonment. Each day of continued violation shall be considered
a separate offense.
