GENERAL REFERENCES
Officers and employees — See Ch. 48.
All officers and employees of the Borough of East Rutherford to be employed hereafter by the borough are hereby required as a condition of their employment to have their place of abode in the Borough of Fast Rutherford and to be bona fide residents therein, except as otherwise provided by law.
As used in this chapter, the following terms shall have the meanings indicated:
BONA FIDE RESIDENT
A person having a permanent domicile within the Borough of East Rutherford which has not been adopted with the intention of again taking up or claiming a previous residence acquired outside of the Borough of East Rutherford.
This chapter shall not apply to or be a condition of continued employment for those currently employed by the Borough of East Rutherford and who are not residents of or do not have their abode in the Borough of East Rutherford.
Failure of any employee or official of the Borough of East Rutherford who is not expressly exempt or excluded by statute or otherwise from a residency requirement as a condition of employment to comply with this chapter shall be deemed a sufficient cause for removal or discharge from the services of the borough.
The Mayor and Council are hereby authorized in their discretion, for good and sufficient cause being shown, to permit an employee or official of the borough to remain in the employ of the borough without complying with the provisions hereof, where:
A. 
The health of any employee necessitates residence outside of the borough limits.
B. 
The nature of the employment is such as to require residence outside of the city limits.
C. 
Specialized talents are required, such as professional services of engineers, attorneys, auditors and kindred talents as are occasionally required.
