Borough of East Rutherford, NJ Article III Cigarette Vending Machines

[Adopted 1-1-1982 as Sec. 4-7 of the 1982 Recodification]

§ 289-8 Definitions.

As used in this article, the following terms shall have the meanings indicated:

CIGARETTE VENDING MACHINE

Any automatic vending machine for the sale of cigarettes and operated by the insertion of a coin or coins.

§ 289-9 License required.

No cigarette machine shall be maintained for operation within the Borough of East Rutherford unless the license for such operation has been issued therefor by the borough upon application and the payment of the required license fee. Application for such license shall be made to the Borough Clerk upon a form to be supplied by the Borough Clerk for that purpose. The application for a license shall contain the following information:

A. Name and address of the applicant.

B. Location where the machine is to be maintained for operation.

C. Description of the machine to be covered by the license, including name of manufacturer and serial number, if any.

D. The name, address and telephone number of the person responsible for the operation, maintenance and servicing of the machine.

§ 289-10 License fee.

Every applicant, before being granted a license, shall pay a license fee of $50 for maintaining each cigarette machine within the borough.

§ 289-11 Standards for machines.

No cigarette machine shall be maintained for operation in the borough unless it complies with each of the following requirements:

A. The machine shall meet all pertinent requirements and regulations of the Board of Health of the borough and be approved upon any inspection made pursuant to such regulations.

B. The machine shall be properly labeled so as to identify the kind, type and grade of product dispensed from any opening as well as the producer of each such product.[1]
