No cesspool or privy vault shall hereafter be constructed in the Borough.
Every owner, lessee or tenant of property which is not within 100 feet of a public sewer system and which is not provided with an existing cesspool or privy vault adequate to dispose of whatever sewage may be produced on said premises shall, except if the Board allows, within 30 days after an order or notice to do so has been given to him by the Board or its agent, install a septic tank on said property which shall be adequate in function and size and constructed in conformity with the requirements contained and in accordance with the ordinances, rules and regulations of this Board, and with those standards established by the State of New Jersey (N.J.S.A. 58:11-23). Every owner, lessee, or tenant of property which was heretofore not situated along the line of a public sewer system must, within 90 days of the installation of such a public sewer system, tie into said system, and permanently disengage any private sewer facilities.
Within 10 days after any sewer connection is established, all cesspools and all privy vaults in or upon the property so connected shall be filled in with stones, earth, ashes, cinder or other appropriate material.
A. 
The owner, lessee or tenant of any property in or on which there exists a cesspool or privy vault shall clean the same and remove the contents therefrom within five days after being ordered to do so by the Board or its agent.
B. 
No privy vault or cesspool shall be cleaned or emptied except by scavengers who, before performing such work, shall have first obtained from the Board a license to engage in and carry on the business of cleaning cesspools and privies.
(1) 
Application for all scavenger's licenses shall be made to the Board in writing, and shall set forth the number and type of vehicles he proposes to employ in the Borough, the name and address of applicant, the name and address where work is to be performed and such other information as the Board may require. All apparatus, means, appliances and vehicles to be used in said business shall be approved by the Board of Health before being so used, and shall at all times thereafter be subject to the inspection of the Board or its agents.
(2) 
The license fee shall be the sum of $10 for each vehicle used by licensee. Each license issued hereunder shall be valid from January 1 to December 31 in each year, unless sooner suspended or revoked. No license issued hereunder shall be assignable or transferable from vehicle to vehicle by the licensee, without permission of the Board in writing.
Any scavenger who shall commence to clean or empty any cesspool or privy vault shall, without interruption or delay, proceed with the work until it be completed and the contents of such cesspool or privy vault are carried away and removed in airtight vessels; provided, however, that such work shall be performed between the hours of 11:00 p.m. in the evening and 4:00 a.m. in the morning and at no other hours.
Every contractor or person in charge of any construction or repair work in the Borough of East Rutherford shall provide toilet accommodations for the persons employed in such construction whenever it shall be deemed necessary by this Board. If connection with the public sewer system is not practicable, then application shall be made for a permit to install and maintain a temporary privy vault in accordance with the rules and regulations adopted by this Board. All temporary privy vaults must be built and maintained in such a manner as shall be deemed necessary by this Board.
Any person who shall violate any of the provisions of this article shall, in addition to all other penalties provided herein, be subject to the penalties hereinafter set forth in this code.
