A. 
The Board of Health of the Borough of East Rutherford, Bergen County, New Jersey, has determined that there is a need to coordinate and link the certificate of occupancy granted to a facility or premises and the health license granted to the person, persons or organization doing business at said facility or premises.
B. 
The purpose of this article is to establish rules and regulations which permanently coordinate and link the certificate of occupancy granted to a facility or premises and the health license granted to the person, persons or organization doing business at said facility or premises.
No health license issued by the Borough of East Rutherford shall remain valid upon the revocation or suspension of the certificate of occupancy for a facility or premises upon which the person, persons or organization which had been granted the health license was doing business.
Upon the revocation or suspension of the certificate of occupancy for the facility or premises upon which the person, persons or organization which had been granted the health license was doing business, the health license for the person, persons or organization which was doing business at said facility or premises shall be immediately revoked.
The operation of any business for which the health license has been revoked based upon the revocation or suspension of the certificate of occupancy shall be in direct violation of the Sanitary Code of the Borough of East Rutherford.
No health license which has been revoked based upon the terms of this article shall be reinstated without the necessity of completing an application for a health license and paying all fees for the issuance of the license, regardless of whether the applicant had paid any fees for licensing within the same calendar year during which the health license had been revoked.
Any person who violates any provision of this article shall, upon conviction thereof, be punished by a fine not exceeding $1,000. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.
The Health Department of the Borough of East Rutherford, County of Bergen and/or the State of New Jersey are authorized to administer the provisions of this article. The provisions of this article shall be enforced by the Health Officer, or his designee, or the Code Enforcement Officer of the Borough of East Rutherford.
